In retrospect, the judges who heard the en banc appeal do read the newspaper and will take notice of the sanctions against EchoStar in the Voom case. Everyone knows that reputation is important and if this news does have any effect on TiVo it can only help their case against EchoStar. Judges on the panel mulling over the briefs and oral argument may find TiVo even more persuasive now.
The destruction of evidence is unrelated to the TiVo litigation. It relates to a contact dispute between EchoStar and Voom. It does show, arguably, EchoStar's pattern of abuse for the judical process.
