    PEIX Infringing GERS' Patents BIOF Has The Advantage

    As you may know, BIOF is extracting more oil than any other producer.
    BIOF is pulling .90 pounds of corn oil per bushel from their ethanol byproduct.
    BIOF is licensed to use this highly profitable corn oil extraction technology. They're licensed with the patent owner, Greenshift, GERS.

    PEIX is infringing GERS' patents. PEIX has a system that gets 70% less oil than BIOF. PEIX is not licensed to use GERS' method patents. Greenshift's patents cover the extraction of any amount of oil from the concentrated stillage byproduct.

    BIOF has a major competitive advantage over PEIX. The corn oil is highly profitable, it's what allows producers to make a profit during this tough margin environment.

    GERS has pledged to protect the competitive advantage licensed producers like BIOF have over infringers like PEIX. Not only is BIOF getting the highest yield in the industry, they're legal. PEIX could be forced to suspend oil production when an injunction is ordered. This may cause PEIX to idle the rest of their plants.

    The courts recently ruled any amount of oil extracted from concentrated stillage is covered by GERS' patents. GERS is preparing another round of litigation to sue infringers like PEIX. This could lead to another PEIX bankruptcy.
