one that appears on (or in) the box of software when you buy it. It is just there, and might have been viewed as a contract of adhesion or one that you do not really have a chance to bargain for (a lack of mutual assent). There has been some disagreement (in the world of contracts law) as to whether it is a true contract & there was a new proposed, & now abandoned article 2B of the Uniform Commercial Code that was being drafted for a few years to deal with all this. This was because of the way software licenses were sold....I so far do not understand why there is any added cost in going to a paper agreement??? If anyone can explain please do.
