If you dont believe what BBEP did on distribution did enormous hurt to KWK look how their stock price reacted. Even thier stock holders bailed because of distribution cut. Best hardball move I ever saw, give their lawyers or whoever thought this up a bonus.
I think the BBEP div cut was aimed at KWK. It puts KWK under increasing cash flow pressure and reduces BBEP's debt at the same time by using the div to deleverage. I have a feeling the dividend will return as soon as the suit is over, which may now be earlier than before.
The duration of the distribution suspension and the amount of the distribution upon resumption will almost certainly have considerations relating to KWK. however, at the moment, the suspension is absolutely connected with a lending agreement prohibition on distributions when the outstanding balance on the credit line is greater than 90% of the maximum credit.
That prohibition is the basis and legal justification for the suspension. Absent that, the complete suspension is another matter which KWK might complain about.
