What a shame that the jury had to leave to deliberate when the injunction hearing occurred and Qualcomm put Charlie Persico on the stand. Persico contradicted Qualcomm's expert Jim Jaffe. Persico who is in charge of all RF chips at Qualcomm made is quite clear he knew they were using ParkerVisions technology. It is amazing that he completely contradicted Qualcomm's damage expert. Persico said it would take over 3 years and 1000's of man months to design around PartkerVisions technology and doubted if it could be done at all. It is clear that Qualcomm lied to the jury about damages, the value of ParkerVisions technology which is clearly huge and that the non infringing technology noted by Qualcomm is not available. The jury would certainly be angry to learn that Persico was right outside the courtroom and was never put on the stand as a witness.
I am told Persico was questioned specifically about what it would take to design a different circuit to replace the one currently used and not the issue of infringement. Its assumed for sake of Qualcomm's position that the decision of the jury has standing and that makes Qualcomm's job to limit timing and severity of impacts. I don't think Persico was making any statement on Q's continued position that the company does not infringe. Persico is forced to push that to the side and deal with the issues at hand.
