All the legal fireworks are centered on the recent Cisco and Apple suits...Yet, quietly, this MSFT/Skype suit could be a nice positive for VHC after their recent difficulties with the two aforementioned companies.
Assuming that Skype uses VHC products, it seems hard to believe that MSFT would litigate this to the bitter end in light of the licensing deal VHC struck with MSFT several years ago...If VHC has a straightforward argument for its contention that Skype is infringing, I would think MSFT would agree to settle, rather than "go to the mats" over this one.
If VHC wins, it should restore some luster to the VHC story.....
Did VHC move to Nevada for just the scenery? Or, were they motivated by 13% state/local taxes in CA versus zero in Nevada, esp if they believe they will be coming into signficant revenue from licensing streams in the near tuture (the next 12-24 months).
Apple and Cisco will exhaust almost all legal avenues before ever paying a dime to VHC...MSFT may not wish to antagonize VHC again, esp after their first legal loss.
Just my thoughts
Some of the wording in the press releases indicate speedy settlement and not wanting to drag out in court. Of course we have all heard that before. Why would Msft risk another suite and treble damages. My take is this will resolve fairly fast. But what does fairly fast mean when it comes to these issues. Its not like you and I sitting down at a table saying I will sell you my Harley for $15,000 and you offer $14,000 and we settle at $14,500. That would be for reasonable people with out attorneys present.
I think they just renewed the lease in Nevada, month to month. Probably taking longer then Kendall though also. 13% tax is a lot once the numbers get big.Lets hope Msft isnt as stubborn or as dumb as Apple and Cisco .
willie, I guess I need to remind you that CSCO was a slam dunk for treble damages. Do you really think MSFT is afraid of VHC now? They know what defense to use as they saw what CSCO accomplished. VHC doesn't have much of a chance to ever win in court again. Everyone now knows how to defend against VHC.
