So let us assume that we based our investment decision on the statement from the CEO that an Ecosystem partner would be announced in 4-6 weeks or earlier starting Feb 26 2012. And let us assume there is no announcement by then, and we suffer an unduly loss due to this mileading statement from Unipixel CEO. Is he and his company liable to pay damages for that, as I believe? Does Mr Reed Killion realize that ?
You have to distinguish between statements of fact and matters of opinion. This requires an investigation into context. Clearly in a business transaction many events can transpire that causes delays; if you haven't been in business, you might not understand this. At the end of the day, no absolute unconditional promise that an event would happen by a date certain was made. It was a guesstimate, subject to the vagaries of the subject matter of the deal, the parties, the attorneys etc.
PS. How much has Seeking Alpha made for you lately?
no, ia m not the author, i am not scared, I am long UNXL and quite frankly i am concerned about facts, not fiction as in SA blogs, and anyway worried about my money, certainly not about your money; having said that, people, and in particular CEO of publicly trading companies, need to act responsibly. He stated that an ECO system partner would be announced in 4- to 6 weeks or earlier and he needs to deliver. One more week to go. Otherwise he can be held responsible for spreading false information which think is a crime in the US, considering his role, like in any other developed country. Am I right or not?
