Suppose VRNG goes the distance, no settlement and wins a big decision in the 1B range. Google could appeal sure. But wouldn't they run the risk of VRNG getting an injunction until the appeal process is over? Also, should VRNG prevail in this case and there is an appeal by GOOG, who's to say a MSFT or someone like them with deep pockets now sees that VRNG won on the infringement issue and buys them, VRNG never goes to the appeal process, but instead someone else buys them AND the patents and can now can sue for even more and cause GOOG all kinds of headaches for years to come....just a thought.
Of course it could happen and another reason why I'm holding a VRNG position after the verdict comes down. Collecting damages from GOOG is just the beginning IMO, VRNG becomes much more valuable when their patents are validated by a guilty verdict against the GOOGster. Everyone knows that AAPL would love to have the VRNG patents, etc
Yes, Vringo would have to use the patents to show harm, but since they are a NPE(don't make anything) they wouldn,t be granted the injunction under the terms of the E-Bay vs. Merc decision, HOWEVER, if MSFT bought Vringo, since they have BING, a search engine, THEY would be harmed by Google's infringement, and could get an injunction. And don't think Google isn't pondering that possibility, unless they are so full of themselves that they think they are unassailable.
