There already is a firm trial date. And Alcana scientists have already been ordered by a canadian court to return stolen documents.

In addition, while we cannot currently determine the amount of the royalty obligations we will be required to pay on sales of future products, if any, the amounts may be significant. The amount of our future royalty obligations will depend on the technology and intellectual property we use in products that we successfully develop and commercialize, if any. Therefore, even if we successfully develop and commercialize products, we may be unable to achieve or maintain profitability. "
Thanks for clarification. If Alny admits to wrong doing why go to court? Again I am not a legal expert but it sounds like Alny needs to share future revenues and pay what is due. This will be least of Alny concerns in longer term. The company needs to successfully pass a target thru clinical and get an FDA approval. What if it doesn't? Would it have enough money to continue?
On another note, what is the deal with this $10.75 a share offering? It is below market price as of this evening and it is offered to the same firms who have analysts covering the stock. Talking about unethical conduct. These firms, if they consider themselves as having an unbiased opinion on a stock, should not be accepting an offering below market.
I hope shorts push this below current levels and give us an openning for more trading opportunity.

Looks like shorts can't do anything at the moment. Raising 70M+ is still a big deal for a biotech after a run up like this. Don't be surprised if this goes much higher in the next month/year as it becomes clear the technology is really that amazing.
