TKM v. ALNY, date court clock is ticking....

TKM has court winning arguments without any doubts. ALNY and former TKM employees were caught red hands stealing TKM IP. Odds are overwhelming in TKM favour. Judge already put stop on ALNY attempt to drug the case hoping TKM will run out of money. ALNY has wishful thinking, On a contrary, TKM will get more money since US government extended Ebola research. CRPT lost own Ebola research funding. This is another confirmation of TKM IP strength, ALNY best rational chance is to buy TKM or get in with some form of merger. Or, ALNY is hoping that US court, US judge and US jury will dismiss overwhelming evidence and endorse criminal activity? Not a chance, US is fighting for IP protection around the world and it will not jeopardize own attitude by endorsing patent stealing in own backyard.

"Alnylam Says Estimates of Damages in Tekmira Suit Could Reach $1.5B"

      November 08, 2012

"Alnylam Pharmaceuticals this week disclosed that a jury trial for its trade secret litigation with Tekmira Pharmaceuticals is expected to begin Nov. 14."

"These theories estimate Tekmira's damages could be in range of approximately $61 million to $234 million. If aggregated, the “theories of monetary recovery included in [Tekmira's] most recent expert report … would result in damages within a range of approximately $310 million to $484 million,” Alnylam said in the SEC filing".

“In addition, under one of the plaintiffs’ claims, any compensatory damage award sum could be subject to doubling or trebling, which could increase the potential damages up to approximately $1.5 billion, and the plaintiffs would also be entitled to recover their reasonable attorneys’ fees,” which were reported to be $12.5 million as of June 30 and are likely to now be “significantly higher.”
