Question: Is this Samsung case only to determine whether there is infringement and if so to effect an injunction or does the ITC have the power to force a settlement, determine a fare rate and end this thing once and for all. Or refer the case to arbitration. What power does the ITC wield?
Also, the old $130M (give or take) case with Samsung draging on for years with 2 arbitrations against Samsung - What power does the judge handling this case have? Can he institute and injunction or only the ITC. Can he rule that Samsung must pay immediately? Can Samsung just continue to thumb it's nose at our judicial and arbitration systems? Want teeth does the Judge have to effect a payment from Samsung.
Anyone who's a lawyer or with keen legal knowledge, I'd love to hear your thoughts (not just "They owe us and must pay eventually" - that doesn't help)
idcc may win the settlement but may not be paid. they might have to hire a sheriff to serve samsung and put a lean on its business until eventually samsung is sold and escrow will disperse idcc's recovery to them.
