That's one way to look at it. The other view is that the amigos had ten years to take a license. If you give them more delays, then perhaps they will simply do that - delay. Arguably, a firm trial date (as originally proposed by Judge Kramer) brings the parties out of the posturing status and encourages them to settle up. I've seen this happen in person in another case. So my view is that if you want a settlement, keep the trial date intact.
