Right. If I read your warning correctly, because it was posted in a public place, then the public was aware and there is no case. What do you know of the law? Other drugs have recently been approved with similar warts, so this case has no merit. ISIS cannot know and cannot represent, with 100% certainty, that it will gain approval. The case would only have merit if antisense did not work at all, and the company hid the failed efficacy and falsely reported positive effects in a Phase III trial. None of this is alleged so, the case will be dismissed.
Apparently, I know more about the law than you do. I've been in thousands of trials. Also, I've stated more times then I care to remember on this board, " Antisense works just not good enough" , then there are the side effects to same technology. I have not read the complete scope of this lawsuit as only the perimeter is available at this time.
