Here is the point. Trial before the end of the year and seperate cases. Now AOL can go down three times.
I can tell you that no other judge of this court has the power to order me to CONSOLIDATE any two cases on MY docket, and I can further advise you that I WILL NOT CONSOLIDATE the AOL case with Tacoda. Tacoda is going to be ready for trial at the end of this year and right now I have it down for trial just after Thanksgiving, with jury selection to occur immediately prior to Thanksgiving. Order your calendars accordingly. Whatever res judicata effects flow from my determination to try the Tacoda case now will happen.
I will be getting back to you tomorrow with a final scheduling order, but rest assured that it will not be impacted in the slightest particular by the fate of the AOL case.

darn this judge only took 5years.... almost to the date to get something going.i hope she will not take another 5 years to finish the job.
If it's legitimate...and the tone of it is decidedly unlawlerly...it's nice. However, it sort of just confirms what we already assumed would happen.
I'd like to see the stock set a new 52 week high by going up rather than seeing the 52 wk low keep coming down to meet the whatever the current price is.
Again, if we get a nice boost tomorrow it will merely confirm what many of us here have been saying for quite some time...good news on the legal front drives the price UP. Sadly, it seems whenever the management reports actual business results it drives the price DOWN.
Let us all relax and see what the next couple days will bring. Much damage has been down lately. A nice boost might get us back to where we were 10 days ago.
Hopefully this little release doesn't set the price up for another damaging dilution.
