That's correct. According to an executive proclamation, the head of the DOD can now just order it on national security grounds. So thank fortune it shouldn't have to go through the Chimerix-vulnerable process of appeals, where Clerici basically stuck a monkey-wrench into the works. (He's not working for Chimerix any more, after the media attack he engineered via the LA Times stung Barda as well as Siga, and made Barda predisposed to sting Chimerix in return.)
If SIGA has received a follow up order(s), insiders surely cannot buy SIGA stock. One of these quarters, BAM! An extra $500 million to the bottom line. Not that far fetched of a scenario. In fact, quite possible, IMO.
If the USG suspects a smallpox attack.... they can buy all the Arestavyr they want with no contract whatsoever. They can bring in boxes of 100 dollar bills they took from Iraq to pay for it. All of this "other than small" and "two animal rule" stuff is just keep the lawyers busy in peace time.
