We know they are generating cash at $225 million/year. They are restricted from paying dividends until they file, so the cash is just building up in their bank account.
TERP is being sued for $231 million, but there has been no verdict. It remains to be seen what amount, if any, they will have to pay.
SUNE creditors have no claim on TERP assets. If SUNE liquidates, the TERP shares that SUNE owns will be sold to new owners with zero effect on TERP assets.
