    CMRX order in play

Brincidofovir was also tested on Ebola: the one American who got it. He died. Chimerix entered a trial on humans. And then they pulled out.

Of course the drug also failed its only two tests on primates. In other words, it has not proved effective on humans or primates for any indications at all.

Monkeypox. Hmm. How many drugs have established efficacy against monkeypox in primates? How did Chimerix's drug do in its only primate test? .... Musher, if you are there, can you still find Chimerix's description of its primate results (that they took off the Web in 2009)? You had it once upon a time. I'm trying to get info for an article on Chimerix's insane BARDA contract, and good old CMX is very slippery.

Drod isn't bitter, for God's sake. He's short. No one would spend the amount of time on a message board to run down a company unless there were a profit motive.

listened to oral arguments to the SC

BARDA did not even exist at the time of the breach of faith. It came into existence that Dec. of 2006, and it did not even issue its Strategic Plan until Oct. of 2011. That plan articulated the principles, goals, and strategies it would then use to develop medical countermeasures. So we are talking about an award relying on earnings that would come from a govt. body that did not exist, a body that would be guided by principles that did not exist. Anyone who says that the award was NOT speculative is talking through their hat. Period.

Alpha, pharma deals and legal awards are two very different animals. One can be based on hopes and suppositions, the other (in the case of expectation damages) is supposed to be based on concrete sureties at the time of the breach.
