yes, like chipotle this is a billion dollar recall that will rock the industry. pure traded $3,00 in shares today, despite having fda approval for just such applications for months. why is that? complete and total incompetence is the only possible explanation i can see. an utter failure of sales effort, marketing and PR. give it a few years, maybe someone will call their offices. truly an amazing thing to watch.

the company isnt flawed at all. what they have done is remarkable. it is very early in the process of implementing their product. every interaction with the FDA is going perfectly for the company.

the company under tax law can use the nols, however, the irs doesnt want the company to be purchased by another entity who needs the nol. used to be easier. so the rights distribution screws up the ability of a suitor hostile to board intentions to take over the company, due to the preferred shares existence. it is kind of humorous actually and is not a benefit to the shareholders. the management barely owns any shares. they know why they are there and shareholder value has nothing to do with it, except hypothetically. so they fantasize that some miracle will happen and they will need to shelter a lot of profit.
this may be cynical but after 20 years of failing, if you have not figured it out, you are not going to. a buyer might have come in an fixed the problems and fired the geniuses who cannot grow sales or make a profit. someone however does know how to maneuver with reverse splits and poison pills. it is hard to remove leeches and hard to kill vampires. hence a company priced to slowly go bankrupt.

this is about the same as my experience. however, i have not been in a 7-11 where english was the first language. i do not believe that i got an honest assessment at any of the stores except two co-owned stores which said they dont want 7-11 select products at all. in another the product was moved to low priority location in the fridges. the eye level positioning is gone from all stores of late that i have been in.
my only point was that sending an employee to a local store and bragging about on fb and twitter is utterly pathetic. it isnt marketing. where is the marketing? none announced. also, the soda has been on sale from day one. buy one and get one for a dollar. so they are making discount private label soda instead of building the brands. sobe sampled and was sold in four years. jones is 20 years with sales per state of $600 per day. clear on this? $600 dollars per day average. they sell per state $25 per hour, gross. quite the juggernaut.
