Thank you for the excellent work! So this raises questions. Why did Hybrid Audio in Tyler TX transfer assets to a new Hybrid Audio in Virginia? What advantage did this provide? Why did Hybrid fire McCool Smith who was supposed to be one of the top patent law firms in the US? Why did Hybrid file suit in Mass.? Why Arrowood Peters? So IF Aware is sill a minority party with no control over Hybrid (assume they own 49% of Hybrid) it appears that Aware got fed up with McCool Smith and took the case to a Boston litigation firm. Corporate counsel for Aware if Foley Hoag and they must have recommended Arrowood to Kevin Russell. Three important questions need to be answered: 1) Why did Aware transfer the patents to Hydrid Audio to begin with? Seems like a total bust and stupid decision. 2) Who owns the New Hybrid Audio? (are the the same players as the old Hybrid Audio) 3) Did the old Hybrid Audio ever recover any money and was more money paid to Aware that has not been announced? While I am optimistic about going after Harman and Panasonic for the future I want to know what happened over the past five years. The people who made the decision to transfer the patents to Hybrid owe the shareholders an explanation for their actions. Right know all I see is Dumb and Dumber.

Wow! Now things are getting interesting. Panasonic is a big company. So the Harman suit and the Panasonic suit were filed in Massachusetts? Who is the law firm representing Hybrid? Why do you say the "new" Hybrid Audio? Since Aware is based in Massachusetts and Hybrid Audio now based in Virginia very interesting suit was filed in Mass.

Great find FD! So if Hybrid Audio sent a letter on January 5, 2011 to Harman that they were infringing but never filed suit appears they felt they would negotiate a licensing agreement they did not want to get nasty. But over five years later and Harman just ignored Hybrid so Hybrid got fed up and filed suit. Wonder why Hybrid moved from Tyler Texas to Fairfax VA? So was suite filed in VA rather than Texas? Is McCool Smith still the attorney of records for Hybrid Audio? Assume Aware has 49% interest in Hybrid. If Hybrid could get $10 million a quarter from Harman then Aware would get $20 million annually. There has to be a payday here otherwise it would not have been pursued in 2016 after many years.

Elite when I read the bios of the Principals at the Incadence website I was less than impressed. My feeling is that these products like Ares are not products they have created but rather they are using other companies software under a licensing agreement but giving the product their own label to make a third party believe that these are Incadence products. With a female President at Incadence (daughter of owner) they also qualify for government set aside contracts for women owned businesses. My gut feeling is they are using Aware products and flying under the radar. The next Aware press conference will clarify everything.

After looking at the InCadence website it appears they are an. Integrator and not a software developer. Are you suggesting that InCadence is using Aware biometrics products in their winning bid with the US Government?

  • Hybrid Audio's Appeal of their patents was successful in December 2015 and yet no money has flowed to Aware Inc. My belief is that Aware will receive money in Q2 2016. I am hopeful of $10 million to $20 million. However, if Aware does not announce money from Hybrid Audio in Q2 then my belief is we will never receive any money from Hybrid Audio. If I am correct in my understanding of the litigation the defendants all settled pending the patent challenge. All that remains is for the defendants to pay settlement funds per the terms of the settlement. Nothing else makes sense.
