what happens to the vast amount of data....

    It's still right there baby!

If I have a CHOICE to use HLF computer service.... I should have the same CHOICE to discontinue without penalty.

If I want to switch cable TV company's... My current company won't come TAKE my TV AWAY just because I switch to a different provider!!

    ...the Herbalife way!!!!!!!

  • sly_coyote by sly_coyote Jan 5, 2013 12:07 AM Flag

So as a distributor I can CHOOSE to pay an annual FEE for which HLF will provide me with computer database functionality: including among other things the CAPABILITY to record my SALES to CUSTOMERS.

    Rule 7-A Annual Processing Fee
Herbalife agrees to provide computer processing services
for Distributors for which an Annual Processing Fee is due.
Such computer services are limited to maintaining discount
rates, lineage records and qualification status. Please
contact Herbalife’s Distributor Relations Department for
    all appropriate fees.

HOWEVER, if I don;t want to pay this fee at some point in the future- HLF will TERMINATE MY DISTRIBURSHIP!!!!!!!!!!!!!!!!! and I WILL LOSE all of my ENTITLEMENTS!!!

Rule 7-C Non-Payment of Annual Processing Fee
In the event that a Distributor does not submit payment for
the Annual Processing Fee by the date due, then Herbalife
reserves the right to cease maintaining such computer
records. Additionally, in the event that a Distributor does not
submit payment, the Distributor will be deemed to relinquish
their Distributor status and thereby all rights and interests in
their lineage and Royalty Override or bonus entitlement.

    1) This database ought to have some RETAIL SALES data that HLF claims they cannot determine (of course retail sales data is irrelevant anyway)

    2) If you sign up for the service you CAN NEVER STOP IT!!!!!!!!!!!

    what an OPPORTUNITY BABY!!!!!!!!!!

WOW this company KNOWS HOW TO FLEECE ITS VICTIMS!!!!!!!!!!!!

  • As has been highlighted from victim blogs- a fee for information is the FIRST step in the recruitment process:

Yet in HLF's current (2012) Marketing Plan and Business Rules this is NOT ALLOWED

    Rule 2-B Payment for Information

Except as provided in Business Methods, Rule 1-C “No
Required Purchase Other Than International Business Pack”
(in the “Supplemental Rules” section), a Distributor may not
request a prospect or an Applicant to make any payment, or
purchase products or materials in return for any information
or assistance about becoming a Distributor. Distributors may
not represent or imply that payment or purchases are required
(legally, or as a matter of practicality) to do or succeed in the
business, participate in the income opportunity, or receive
training or upline support. (Refer to Business Methods, Rule
1-C in the “Supplemental Rules” section of this book.)

But again, even before purchasing an international business pack... victims had to pay for INFORMATION:

Most people requested the free information
(blue books). We were required to mail out at least 25 of these a week. However, few people
were willing to spend the $35 for ADDITIONAL INFORMATION. We eventually sold two or three

Consumer Class action suit BREWING right now:

    by sly_coyote Jan 4, 2013 6:58 PM
    sly_coyote sly_coyote Jan 4, 2013 7:45 PM Flag

Another victim EAGER to participate in the class action suit...

Where am I now? Well after havingperfectcreditfor 20 years I'm on my way to bankruptcy court
this June 2007 and I can thank Herbalife because I needed to spend so much money on leads and everything else to keep my head above water, I am completely broke. I will not accept that I am a fool.

I followed them and did my job with a clear conscience.

I don't know how they put their heads on their pillows and sleep atnight. Maybe they actually toss and turn, probably not. If I am bitter I have every leg to stand on. I am a very positive young lady who's sweetness was taken to the cleaners. So,for those of you who work for the company who say that you work hard and that's why your doing well, please don't insult my intelligence.

Just waiting for the day when Herbalife folds, then the celebration will begin.

    How Will HLF Explain this?

    by sly_coyote Jan 4, 2013 7:22 PM
    sly_coyote sly_coyote Jan 4, 2013 7:37 PM Flag

I answered a newspaper add for "Computer Work, Great Pay just processing nutritional
supplements. "I was told that I just had to take orders, and I would be trained online. It was only
$10.00 to get info. So far sounds great-right?

  • Another Victim reports:

Then I thought to myself - how'd I get to this point. It was from answering an ad in the paper for
computer help earning $25-$75 pt/ft. Wait a minute. It doesn't mention anything about retailing,
which to my knowledge isn't computer help. And it also doesn't mention all the investment

  • The below victim's comments (and question regarding how to get her money back) ring loud and clear to the multiple class action legal teams salivating to be the first to get their TV ad in place:

"If you have been harmed by Herbalife... Call the 1-800 number now!!!!!!!!!!"

"I am in the same boat as the rest of them. Six years ago I got involved with Herbalife and really
went under. I am currently paying $420.00 dollars a month for the next five years to get out of my
credit card debt and still trying to figure out how I can get my money back from them. My
Mentor told me the more you spend the more you will make. Not true. Anytime someone brings
up Herbalife I tell them they are a bunch of hypocrites and they will not tell you the truth. We
could have before I went in debt with them."

"I am a Former Herbalife distributor and I lost over $20,000 dollars. I don't even know if I can
save my marriage. My husband is so angry with me I don't think we are going to make it. If I
could do it all over again I would have never gotten involved with them. Now I struggle with my
self-esteem and how I feel about myself. This whole experience has almost destroyed me. Put it
this way, if I lose my husband it will destroy me."

  • source: Ackman Testimonials section of site.

It was the prospect of money that kept me going. Spend $5,000 and get $10,000 back – that was
the plan. My sponsor told me to put it on my credit card, and I will have the money back within
the month. Well, you can imagine what happened. Two months down the track I had $5000 worth
of stock sitting in a cupboard - I had no money, no customers, and no help. I was stuck. I had
bought all these products from Herbalife, because a man I thought I had trusted told me to do so.

But he didn’t even call me anymore. I BOUGHT IT, he soon realised that I wasn’t going to sell any
of it, and his job was done – HE GOT PAID.... at my expense. I had a credit card bill the size of
Texas, and had nothing to show for it. Expect a whole lot of over-priced weight products - I had
    been sucked into this scam.

    (emphasis in caps mine)

    I know this....

If the "he" in the above story didn't receive ANY monetary gain UNTIL the "she" in the story sold her product to a "customer".... then there would be no debate whatsoever.

However the "he" receives his monetary gain at the time of the PURCHASE by the "she".... REGARDLESS of whatever happens to the product....

    THAT IS A PROBLEM!!!!!!!!!

    Ackman knows it!!!!!!!!

    The FTC knows it!!!!!!!!!!

    ....and JOHNSON knows it!!!!!!!!!!!

Why has the Jan 10th rebuttal now been reduced to an "educational seminar"?????

instead of "tear Ackman to shreds" point by point counter?

(Notice where the product was ULTIMATELY "dumped")

When we complained to the supervisor, we were told to keep doing what we were already doing,
only double our efforts. We were barely making enough money selling products to cover our
business expenses. We were also required to call the Herbalife network phone directory daily to
listen to pre-recorded "pep talks." They calls averaged 30 minutes to an hour, and we also paid
for the these calls. Herbalife also requires that it's distributors pay annual "membership dues" of
over $50 to remain a distributor.

My husband and I gave this business adventure 20 to 30 hours per week, doing everything we
were told to do while our advisers continued the empty promises of residual income checks. The
most we ever got from Herbalife was a check for $3, not the thousands as promised. We were
also required to place a personal order for ourselves that HAD to total $100 or more a month,
each and every month. After almost a year had passed the Herbalife business left us thousands of
dollars in debt with nothing to show for it. At this point our immediate supervisors had quit the
business and we were dealing with their supervisor in Wisconsin. She just flat-out quit helping us
or returning our calls. We decided to cut our losses and the supervisor in Wisconsin agreed to buy
our recruiting supplies and pay for the shipping. I sent off 3 large boxes to her and had to contact
her repeatedly to get her to pay for the items. She finally did, but she stuck us with the shipping
cost of over $80. We finally sold the rest of our inventory on eBay for a pittance of what we
    originally paid for it

  • An excerpt posted by a (former) and now failed, distributor:

Available on Ackmans site under testimonials:

We tried very hard to build our new business. We sent out the letters to friends, associates, and
relatives. We placed ads in newspapers across the U.S. and put up flyers, distributed business
cards everyplace we went. We worked all day and then spent 3-4 hours every evening, 5 days a
week, distributing flyers and cards, making cold calls, or making preparations. We talked weekly
with our supervisors (at our expense), who told us how to advertise and how much to do. The
newspaper ads alone averaged $300/month. We went to seminars, wore buttons, and talked to
strangers constantly, all encouraged by the company. Most people requested the free information
(blue books). We were required to mail out at least 25 of these a week. However, few people
were willing to spend the $35 for additional information. We EVENTUALLY SOLD TWO OR THREE DISTRIBUTORSHIPS. We had very little luck selling the product itself. People thought it was just too
expensive. I made 3-way calls (once again at my expense) with potential customers and my
supervisor, trying to sell product. My supervisor eventually gave up trying to help me sell the
products this way! We were left to flounder by ourselves. Friends and relatives were the only
people we were ever able to sell products to.

  • To me this means a crowd of retail investors has bought in (on margin accounts).

Are these investors or traders? are they strong-willed.... or are they going to crumble when they see it pull back a little?

  • 48+++!!!!

Can I have my shares back please!

    ...resigned to selling puts now-

    collect premium-

maybe I get filled and get some shares back.

  • I do believe we have topped for the moment.

I think the SODA rally as well as the larger market rally will (unfortunately) be faded.

44.50- 45.00 is in the cards. (IMO) RELOAD when it hits!!!

    Seth- EXCELLENT piece as always!

  • Johnson's not finding any suckers to buy this Stinky floater!!!!!

He's going to take you fools down-

Section 17 Customer Retail Receipts and the
    Customer Refund Policy

Rule 17-A Providing Retail Receipts to Customer

A Distributor must provide an official completed Herbalife
Retail Order Form to all retail customers when the sale is
completed. This must list the products sold, the sales
price, and the name, address and telephone number of
    the Distributor and the customer.

Distributors are required to maintain their copy of all Retail Order Forms on file for
a period of two (2) years. Herbalife maintains the right to
request copies of these and to verify the transactions and the
terms and conditions of the sale, and the service provided by
