How is that fraudulent? He even stated the vin was not actual and he was making the submission to alert agency of a pattern of failures.
Might not be "proper" use of the system, but was it to "done to trick someone for the purpose of getting something valuable" ?
If the incidents never happened and were totally fabricated, and photoshopped, and he benefited financially, then there may be a problem. I have no idea if he was short TSLA, but I've seen the photos, and they appear genuine.

I think youre probably right. The recent hype / improbable numbers about the model 3 reminded me of when the gigafactory, and energy storage were touted in order to keep the hype alive and the pps up.

Good point about previous offerings not being used as they were supposed to be. Telsa is getting shakier, and its no adding up. The gigafactory has been downsized, and real partners were never found. What do they know that Musk isnt willing to say?
Picking up a few shares here, as risk reward is attractive here.
If it is indeed a personal / health issue, then stock should recover quickly.
