    The shorts are fueled by the uncertainty about what the Justice Dept will do. To me, it's obvious they will not interfere with the FDA's decision based on the reasoning they used to approve it. Any guesses out there on when we might see the dept make this clear to the public?

    Any guesses on when the Justice Dept will address the attorney generals concerns? That "unknown" is the only thing fueling the shorts. "Unknown" since it's painfully obvious what they'll say when they finally decide to say it. No reversal, go back and read the FDA's statement during approval in regards to ignoring the panel's opinion not to approve it. My guess is before year's end.

    Straight from Bob Rappaport, a director at the FDA in regards to questions as to why the agency approved Zohydro despite the boards recommendation not to:
    "Punishing this company and this drug because of the sins of the previous developers and their products, from a regulatory standpoint, that's something we CAN'T do." "We are OBLIGATED at the agency to operate within the regulatory framework and that includes providing a level playing field for industry. We don't have a choice by that. IT"S THE LAW."
    shorts and bashers, does this make sense?

    Couldn't agree more. In a earlier post, I referred to the FDA's decision to ignore the panel's opinion to not approve the drug. FDA had to approve the drug as it was of no more danger to the public than all the other already on the market. For that reason alone, attorney general will not touch it. Holding strong at 3.08. I only regret not picking up more this morning in the 2.70's

    You do that drd. Your letter will mean nothing to an office that has made major mistakes like market favoritism and has paid for it. Picking market winners is always bad business....they know it. All opiate drugs would HAVE to be banned based on reasoning found in your letter to them.

    I honestly cannot comprehend why shareholders would sell based on the premise the attorney general MIGHT ban the drug. Really? Do they not realize how many opiates are out there and that a fair market would demand all of those drugs be banned as well. It would be a blatant case of selecting a market. Will not know it because despite the government's faults, they know a decision like that could be very costly and embarrassing for them.
    Also, go back to the FDA's approval decision and their reasoning for dismissing the panel's earlier opinion to not approve the drug. They HAD to approve it because of the reasons stated above.

    Who knows. I can't blame them though, just trying to make some money. It's an easy position to take since end of dilution is still 4 trading days away. They'll get their money but the longs will as well soon enough. To me, this one is a no brainer.

    At least dilution is not being dragged out to further hurt share price. After the end of next week, dilution is in the rear view mirror and we can move forward as holders. I'm down significantly but not worried because we all know where this is going the closer we get to market with Zohydro.

    Seems to me, dilution may be close to over. Agreement back in March allows the company to only sell up to 25 million worth in shares. Earnings report states they already sold $10.9 million worth @ $1.66 per share just in the 3rd QTR alone. Does anyone know how much they sold in the 2nd QTR?

    portly, agreed for those who have access to trade during market hours. i do not most of the time so stop-loss works for me and im sure for many others with daytime jobs that limit internet access.
    On a separate issue, and excuse my ignorance,....when does the patent expire on Zohydro?

    Bashers and Shorties....have you heard of it? Keep trying to scare us with dilution, FDA reversal, etc....it doesn't matter. That's what a stop-loss trade is for. Simple fact is a lot of people here are sitting on a 35% profit just from yesterday and you are not. You are also afraid of the position you are or may be in soon so I don't blame you for trying to shoot down a company and product with massive potential.
    I for one missed the big move yesterday but after over a year of watching it on my list, and hearing the decision, I finally took a major position in it about an hour before close. Basically all in. To those who had the cojones to take a position before the announcement, congrats...big time. I'm realistically optimistic I'll share in some of your profits from here on out.
