Doh! Wasn't thinking about the short side. Yes, sorry! Short selling has different rules. In that case, delivery is considered the reporting date, so you must complete your trading so that settlement occurs on or before 12-31. I believe that puts you at 12/26 for your trade date.
Any sell trade that is executed on or before 12/31/2013 will be reported as a sell for the current year and all gains or losses will be reported for the current year. Settlement only matters if you are trying to record a distribution from a qualified account for the current year, as assets must be in cash in order to process the distribution by 12/31.
This is correct. It is the sell date, not the settlement date. Your 1099b for 2013 will include any trades executed up to and including 12/31/13.

Give me love, take it all away again... Wale could have been writing about the stock market instead of life and love. If it weren't for the ups and downs, it wouldn't be much of a ride! I can't remember owning a stock with more excitement and more heartache than Uni-Pixel, but I love "her" still.
