    bp-goldstien - From my Point of view the comments from made......... have been rather professional. If you consider it a pump when somebody navigates through the process since 2012 up to this day, so be it. First, everybody interested in DECN was able to follow step by step what was going on. Everybody had Access to court papers and some other interested parties took up the subject and commented on it. What is then wrong to issue an opinion about a possible outcome? Up to this date, as far as I am concerned, his comments were down to the Point, but then of course as we know from similar cases (Nespresso) you cannot be always right as court decisions may take another turn, but issuing an opinion based on similar cases, is the right of everybody and again, has nothing to do with pump. I would then rather have to come to a conclusion, that your postings could be considered paid bashing.

    Saw this in another Forum.
    "The stage is set for the Friday court hearing in San Francisco. This hearing is what is known as a tutorial, where both sides, J&J and DECN, instruct the judge on the basis behind the J&J case and DECN's defense. Judge watchers will get an idea whether the judge is buying J&J's argument. Both sides will have judge watchers in the courtroom.

    Then the following Friday on the 22nd the Markman Hearing takes place. Called a claims construction hearing, both sides bring in their evidence and their experts.and about twice as many judge watchers. This will be a mini-trial, but critically important where the judge will decide whether any of J&J's claims, in the face of previous crippling rulings, will become part of a trial. The Markman Hearing is where patent cases go to die, or morph into unfair competition and restraint of trade cases. J&J walks in the all powerful Plaintiff and may walk out defending their past actions, future reputations and past behavior. J&J brought similar cases against competitors Home Diagnostics and Roche in 2004 and 2006. These cases both died at their respective Markman hearings.

    The stakes are huge. The courtroom will be full of press people at least at the Aug. 22nd hearing. DECN will walk into these hearings believing that the recent USPTO ruling was worth $30 - $40 million in a settlement. The judges in their USPTO ruling praised DECN's expert and called J&J's expert "unconvincing." Too late for the experts to change their stories. That is already baked into the cake. DECN may walk out on the 22nd, after a single judge comment or two, believing the case is now worth much, much more. The Home Diagnostics case was settled on the benches outside of their Markman Hearing courtroom. This time it will have far more serious consequences because J&J has already lost its mojo.

    bp-goldstien - since the Americans landed on the moon, conspiracy theories made round and the same could be said about 9/11 and more. And so it is then obvious that on Forums same theories are played out if and when a writer Shows more knowledge than the crowd. Just because "S" is well informed about the legal battle does not mean the he is part of the Company. Everybody has Access to the sides who are Publishing court records, verdicts etc, but of course one should know where to find it and if it is a paid Service or free Service. So when he put in the link about the USTPO decision, he was only faster than some others but I can assure you that there are Traders out there who have companies on their watchlist which are involved in legal disputes or companies that are in the race for FDA approvals, and by doing so, do not have to wait for a press-release because they got the Information from a public side. Being well informed does not mean being an Insider it could rather mean, a Person who is doing the homework to protect it's Investment or to understand why the Investment was made.

    August for sure will be an interesting month. Besides some Major court Dates I expect as well DECN to become clear with the filings.
    Here a summary which I took from another board, but the writer certainly said it well.
    there are four court cases on note. The first is the current appeal to DECN's challenge to J&J's patent. The court ruled on August 15, 2013 that DECN had a very good chance of prevailing, primarily because there was question as to whether J&J actually had something to patent, or if not, what other company (Abbott) did J&J "borrow" its "patented" technology from. The winning of this argument, with a ruling coming as soon as next Monday, is incalculable. No patent, perhaps stolen or copied technology, and J&J has no case against DECN going forward.

    The second case is DECN's attack against a court ordered bond based on incorrect rulings, damaging rulings, by the District Court judge that quit, did not respond to questions asked by the patent appeals court, and has all but disappeared. The value of that cash surety bond is $12.7 million.

    The third case is the current patent infringement case where up to this point, DECN has been on defense. No patent, no infringement, and perhaps sanctions and attorneys fees granted for J&J pursuing a bogus case when it had to know that their patent was not worth the paper it was written on.

    The fourth case is DECN's anti-trust case that it has filed against J&J, which in simple terms is a case where J&J knowing it had no servicable patent to infringe, filed a case anyway to deny, DECN's access to a free market. Anti-trust case, think the Vanderbilts and the Rockefellers, carry awards of triple damages. The best way to prove damage is for the USPTO (case 1) to rule against J&J. Then the dominoes fall.

    The first 3 cases will probably be resolved this calendar year. The fourth case might take another year or two to resolve. But for the stock traders only looking for immediate gratification and a free, no work required home run, DECN is in very good shape, and they put themselves that way but doing the right things.

    The USPTO final ruling will get the stock moving again. It did last year.
