"Basically, the Company is claiming patent infringement against anyone with video conference technology or advanced telecommunications software. Frankly, we would have thought George Lucas, R2D2 and Princess Leia had first claim on these concepts. The USPTO may well agree with us (emphasis our own):

"On April 11, 2013, Sipnet EU S.R.O., a Czech company, ("Petitioner") filed a petition for an inter partes review (IPR) at the United States Patent and Trademark Office (the "USPTO") for certain claims of U.S. Patent 6,108,704 ("the '704 Patent"). On October 11, 2013, the USPTO partially granted the request and instituted an IPR. On July 11, 2014, the USPTO held oral argument. On October 9, 2014, the USPTO issued an administrative decision that claims 1-7 and 32-42 of the '704 Patent are unpatentable."3

Note in the above that the '704 patent is the primary patent referenced in the Netflix (NASDAQ:NFLX) and BlackBerry (NASDAQ:BBRY) settlement 8-K. It is listed first in the company's listed patents and we believe the company absolutely considers it their primary patent asset. This USPTO ruling was announced by the company on 10/14/14, after they announced litigation against Apple, Cisco, Avaya and Verizon. The Company has not announced any additional litigation since the USPTO ruling and are appealing the ruling.

STRP has received $18.275mm in settlements and licensing fees as a result of litigation relating to these patents since their spinoff. We know that the company has settled with Netflix and BlackBerry4, Google (NASDAQ:GOOG) (NASDAQ:GOOGL) and Sony (NYSE:SNE)5, Sharp and Bandwidth.com6, Telesphere, Vocalocity, AmTRAN, Vonage (NYSE:VG), ZTE and Panasonic7. Further, we know that the company has settled with 12 companies in total.8 So, on average, the company has received 1.5mm per settlement. However, this headline number does not include expenses incurred (think lawyer's fees) in association with enforcing these patents. "

    "Executive Summary:

Straight Path Communications Inc. ("STRP" or "the Company") has two lines of business. They own an 84.5% interest in a legacy IP portfolio and a portfolio of fixed wireless spectrum assets. The company was spun off from IDT Corp. (NYSE:IDT) on 7/31/13. According to STRP management, the spin off was enacted with dual and parallel purposes. The aim was one, to allow the market to properly focus on the two assets of the company and to assign them their proper value and two, to put a management team in place whose sole purpose was to maximize the value of these assets. 1 At face, this goal seems to have been met with considerable success. The stock of this unlevered company is up 215% since listing. However, we believe that this gain is one of dubious merit. While IDT undoubtedly spun off STRP with the goal of shedding light on these assets, we believe the assets in question were chosen because each have qualities allowing new management to pitch an extremely optimistic story regarding the potential future value of the company. In sum, while the IP and Spectrum assets of STRP undoubtedly have some nuisance litigation and speculative technological value respectively, we believe and will show that the sum of the value of these assets is much closer to $3 per share ($2.5 for the IP and $0.5 for the Spectrum) than the current market price of $20.18, implying a drawdown of 85% for current investors.

    IP Assets

We will focus on the valuation of the IP assets quickly before moving on to the more complex question of the Spectrum assets. STRP has collected $18.275mm from patent litigation so far. They have garnered some headline wins from companies such as Netflix, Google and Sony, which left stockholders in high spirits. However, the patents they own begin to expire in 2015. We optimistically assign this asset a value of $2.5 per share.

What is in the STRP patent portfolio? We'll quote directly from their 9/30/14 8-K announcing litigation against

  • The fact that they got an extension and waiver is pretty good news. I will wait for the conference call to see if there is anything new otherwise no news here. I also think the company would be better off to reduce the cash div for the next year as there are many one time expenses such as accounting and legal.

First, they sold Duracell to cheap, at 7X EBITA and lower than what they had estimated. Second, Buffet will no longer be a shareholder. Third, there is a major price war in many of PG products, it is like they are giving it fro free almost. Finally, stock had a nice run up and is not cheap. Perhaps at $70 I will take a look at it.

Over 10% for REIT, come on be real. The write offs are one time and we will be done with. They also were able to get a better term for buying cooper.
