    Northern District of Texas. On March 19, 2015, the honorable Barbara M. G. Lynn issued a 106-page claim construction order, following the Markman Hearing which had been held on November 21, 2014, construing a total of 13 claim terms that had been disputed by the parties.
    The Court rejected all arguments made by VTech and Uniden related to the invalidity of the '599 patent for indefiniteness. Defendants had argued that two of the claim terms were invalid as indefinite, but the Court rejected this challenge.
    On the '599 patent – the Court rejected Defendants' construction of the "concurrently transmitting" limitation and found that Defendants' claim construction arguments misunderstood the nature of the patent, the prosecution history, and the distinction between the invention and the prior art.
    On the '899 patent – the Court rejected Defendants' construction of the term "network" and their argument that the scope of the patent is limited to devices that operate only on "IP networks."
    On the '614 patent – the Court rejected Defendants' construction of the term "peripheral link", and rejected Defendants' contention that the patent is limited to devices involving physical or wired connections to the exclusion of wired devices.
    I don't think V Tech is in a position to ask the Judge to make a decision that will hurt Spherix based on the earlier court decisions.It seems Spherix's case has legs and the are in a better position to make an Ex Parte Motion to speed up the case.and bring it to settlement. This is good news for Spherix.

    They are in their growing Balance sheet and the growing margins. The 80 million dollar retirement of debt (prefered bonds retired for shares) will only create more cash in the balance sheet.
    The guidance for next quarter is for further growth. This is a company with 6 fabs 2 in Israel, 1 in the U.S. and 3 in Japan. There is still plenty of room for expansion so there isn't need for building any new fabs in the near term.
    It is very obvious that mamalovesshortcakes has been posting negative blurbs. Keep up the good work we need short sellers to be trapped as they were today in a short squeeze.

    livininisrael are you watching the trading on the NASDAQ (American Market) over 200,000 shares already traded by 12 noon. In Israel for today 289,206 for the whole day..Big fight for direction of the share price.

    The reason for this PR report is to bring attention to this Analyst's report. it is obviously positive and Spherix wants this analysis to get out. Spherix can't publish it because it is for people and institutions that pay for the information produced by Chardan Capital Markets LLC, a privately held full service global investment bank. Chardan is a respected global investment Bank.Why don't you google this company before you bad mouth them.
    They recommended Tower Semiconductor (TSEM). which in the past year went up 300%. and could easily double this year.
    Institutional investors will pay for Analysts reports if they are from a company with a successful track record.

    If this was true why has it been the U.S. market that has propelled Tower shares. Most of the big moves up have been in the U.S. market. This is true " majority of Tower stock holders are Israeli and don't come on message boards." That is because of the major institutional investors are Israeli, Israel Corp (now Kenon Holdings) and the Israeli banks (leumi and Hapoalim).
    Tower is more news worthy in Israel than in the U.S. In Israel Tower is a well known company where as in the U.S. it is hardly known at all. Kind of like Hashomer Hatzair an international youth movement which all Israeli's know but is not known in the U.S. (google it).
    It will be U.S. institutional investors that will push Tower up in it's next leg up. Profit and balance sheet increases will get big investors to buy. Tower can easily double in share value this year.

    If there is no reason to buy is there a reason to sell. Is Spherix a worthless company who has no assets of
    value. Right now the Share price is about 1/2 the price that professional investors paid ($2.00 a share).
    RPX now a major shareholder Paid $900 million for Nortel Patents from Rockstar. Marathon offered to buy
    Spherix.
    Spherix's (NASDAQ:SPEX) board has rejected a proposal from fellow IP licensing firm Marathon Patent Group (NASDAQ:MARA) "indicating Marathon's interest in acquiring Spherix in a stock-for-stock transaction valuing Spherix at a 15% premium above the recent market price of Spherix's common stock."

    Cisco paid $188 million to Rockstar to settle an infringement case based on Nortel Patents. The Spherix case is still pending.
    To believe there is little value to the IP that Spherix owns is a mistake. The share price right now is being moved by speculators. It is obvious wallstreet10007 that your interest is for the share price to move down. I believe that the up side potential of Spherix is much higher than the down side.
    One settlement can move the share price up substantially. This stock has moved up 65% in one day (see price move on Sept 30,2014).

    From the PR statement of Spherix, "Under the current litigation schedule, the parties are required to file a statement with the Court regarding the status of settlement negotiations on or before April 2, 2015".
    If the parties in this dispute can't find a way to settle (compromise or capitulate) the court will move forward to a full trial.

    Watch the trading http://www.nasdaq.com/symbol/spex/time-sales lots of 1000 share trades. 100 and 300 share trades are also moving the share price. Price is down $0.10 from the early high. There is definitely a fight going on now and the shorts have not capitulated yet.
    April 2 is the day of reckoning dead line from the court. "Under the current litigation schedule, the parties are required to file a statement with the Court regarding the status of settlement negotiations on or before April 2, 2015."
    A settlement agreement would mean money for Spherix and a vindication of it's business plan to monetize it's IP (patents they own).
    Marksman decision by the court looks very positive and points to a settlement .

    Unlike you livininisrael, I believed in Tower as a turnaround investment as did the Israeli government ($40 million grant) The Israeli Banks large purchase of bonds, Israel corporation (Israel's largest conglomerate) largest share holder in Tower.
    You are correct I have been an investor since 2009.and currently am up $9000 on my investment.
    Tower is now recognized by many world class companies, to name a few Intel,IBM, Panasonic, Samsung, to be a go company to do business with.
    Investing is about the future and Tower now has a bright future ahead.
    If you truly want to get out of this investment when it hits $22 a share bad mouthing the company's past isn't the best way to get to your goal.

    livininisrael are you living in Israel. 10 years of building a world class company isn't all that long . How many Israeli companies can be called international with work forces all over the world. Tower set out with an ambitious business plan to build a world class company and have succeeded.

    They now have fabs in Israel (2) the U.S. (1) and Japan (3). All these fabs have large workforces with a high degree of technological know how.

    This was all accomplished with minimal capital for producing semiconductors (very high CAPEX industry).

    2015 will be a pivotal year for Tower, Analysts see Tower at over $20 a share that is over 20% from where it is today.

    The price movements won't be strait up to take profit today isn't a bad thing. This past month has seen a big move up. If we look at the past share price movements it is clear that for every jump in share price there has been a retreat to only to a stronger high.

    Tower is a company with lots of good news going forward that will only help improve it's share value. The Key to seeing Tower's success is watching it'a balance sheet. This is money at it's disposal for deal making and Capex investment. .

    Picked up another 800 shares for $665.00, a bit over $0.83 a share.. I agree it is best to cost average down. The upside is still stronger than the down side. Let's hope there will be some good news from the Marksman hearing today. 2 million shares short on this float will be gasoline to any serious up tic.

    In Tel-Aviv TSEM up to $17.81. The Israeli stock market up day before big elections. Seems economic issues more important than security issues. Tower seen as a new rising star in Israel. Intel contract was a strong affirmation of Tower's technological prowess.

    Where does any start up get cash to do business before they are making profits? If Spherix owns something of value (Patented IP) some one with money will come forward to keep them going. Deep pocket people and institutions are always looking for opportunities.
    This time around the financing won't be through a stock offering. It could be by a buyout (Spherix was just offered a buyout and rejected it).
    They do have a number of law suits in the works each has millions of dollars at stake. The law firms involve have a stake in these law suits and have a better knowledge than anyone of their strength or weakness. These law law firms could easily be new stake holders through loans, bond offerings ,notes or some other financial instruments.
    There is also RPX now a major share holder who could come forward with money for Spherix to continue or money to buy all of Spherix's patents and shut it down in the same way they bought all of Rockstars Nortel Patents.

    The public float is really much smaller Rockstar (and now RPX who bought out Rockstar) have over 16% ownership of the public float. Some of the other institutional investors have sold (Hudson Bay) but there is considerable institutional ownership.See seeking alpha article http://seekingalpha.com/article/2133933-spherix-a-focused-play-on-patent-monetization
    The trading volume today 03/10/2015 is 52,000 shares the first 2 hours of trading. That is less than $52,000. Any buying of shares can explosively move this stock up. If the share price moves up 10% the shorts will be forced to cover only adding more gasoline to the fire. Check the move up on Sept 30 2014 (Up 65% in one day). Good luck to those shorting Spherix the upside is small compared to the down side. On the reverse side of this trade the downside is small compared to the upside. Long and strong waiting for a big pay day.

    This announcement is more about validation of Tower's technical capability. The Ramp up for production announcement doesn't mention a dollar amount. This announcement comes after the Feb 23 conference call just one week ago. Ellwanger had to know about this ramp up to production but held this info back.
    Tower is traded in the Tel-Aviv stock market and it is already up about 9%. The pre market trading is a continuation of the Tel-Aviv up tic.
    The momentum of Tower is very strong now. Lot's of good news and strong guidance.
