good call. nice to hear some reality vs. the cheerleaders here. I was so wrong it this. As cheap as this where is the positive catalyst in the short term? I think the risk JohnDaley has outlined is real.

market is clueless - this is huge positive - company will save on interest expense and more importantly un-securing assets frees them to sell assets/break up company in medium to longer term --- think NRF -- see you at $20 -- at least

    Sentiment: Strong Buy

    Lennar lawsuit

    by goldencowrie Mar 31, 2014 11:14 AM

This litigation commenced because Lennar acted in bad faith and simply was unwilling to
close and put 1,250 fully-entitled acres with recorded homesites over three parcels (“Bevard
Property”) on its books in a historic economic downturn. Because it had given promises of
specific performance and a corporate guaranty in return for a substantial price reduction, Lennar
could not simply walk away and forfeit its deposit. As a consequence, Lennar either had to find
a third party to purchase the Bevard Property or, to use Lennar’s own words, it had to find an
“escape clause” out of the Agreement of Purchase and Sale of Membership Interests, as amended
(“PSA”). When its efforts to find a third party purchaser proved unsuccessful, and with the
closing date fast approaching on a money-losing deal, Lennar in bad faith created constantly
shifting excuses not to close. Lennar then terminated the PSA based solely on the denial of a
sham written request for access to inspect the Bevard Property, which it had accessed freely and
    frequently for over two years.
