DISH v. Comcast (blockbuster in wings?)

I didnt know Dish were so involved with Video in this 'golden age' .. atHome must be pulling in big $ :)

In Monday's petition, Dish argued that "the rapid rise of broadband-powered online video services has been great for consumers. In many ways, we are in the Golden Age of video. But this Golden Age risks being cut short by the proposed transaction."

OCt is going to be popular .. from Home Mag

Instead of every studio and retailer setting up their own solution for delivering UltraViolet content, Toggle (which has raised an initial round of seed funding from Warner) would provide universal access to UltraViolet libraries for the consumer, using a device that could cost as little as $20, Johnson said.

Toggle’s Johnson said his hardware-first approach for UltraViolet delivery is meant to level the playing field: Just because a retailer got in on the ground floor when UltraViolet launched (in 2011) doesn’t mean it’s “the best or most innovative service,” he said. The Toggle device would have apps already embedded, would be “easy to use and navigate,” would not need to synch to other devices, and would come with its own remote, he added.

Toggle — which became a member of DECE in January — already has one retailer (“One of the world’s largest,” Johnson hinted) on board for an October launch of the device.

    WSJ timeline:

Chapman will hold a hearing on whether LightSquared has made adequate disclosure on July 21.

LightSquared will solicit ballots on the plan starting July 23, and creditors have until Aug. 1 to vote.

Objections to the plan are due on Aug. 12. The parties have until Aug. 15 to complete discovery before the trial on the reorganization plan and subordination of Ergen's claims, which commences on Aug. 25.

The trial will spill over into early September if necessary. LightSquared and its new backers aim for the plan to become effective by Sept. 30.

LightSquared still needs approval from the Federal Communications Commission before it can provide wireless broadband wholesale services. After the FCC pulled its support for LightSquared in 2012 -- finding that the company's planned service would interfere with GPS signals -- the Harbinger-backed company sought bankruptcy protection.

In a July 1 letter to the FCC, the government's National Telecommunications and Information Administration suggested that problems with GPS transmissions have not been resolved. The Department of Transportation also expressed concerns.

Even if LightSquared can resolve the infighting among its creditors, the company and its new backers will have to wrangle with politicians and regulators in Washington.

plus I dont think that Dish bought the spectrum, I think it was an entity controlled by Ergen .. Dish does have the roof top antenna's though, they and eTelcos have begun rolling that out, wonder if that can be used for the Kiosks .. I still see BB on it's own milked by the Studios and paying for the pipe, Dish being sold and Ergen making seperate $ from all 3 .. just IMO!!

I think all will be forgiven .. see below!!
I think Charlie will own a piece of LSQD and he will make HIS $ from it .. dont think Dish is involved, may even be sold. BB (is spun off, like Charlie said years ago OR BB/Dish) can then be a partner to LSQD .. it's the Studios that will make the most $ from BB but I guess Dish/Charlie will have their hand in there too for a % of delivery fee.
I dont think LSQD will be solely be for BB/movie dist .. the bus model is to partner with multiple COs .. will they use Dish's nation wide spectrum?
Who knows but it seems that the delivery system is closer to being complete and hopefully BB will be back in the picture!!

A lawyer for LightSquared said Monday that the litigation regarding those claims would now be placed "on pause." He also said the company hopes to be out of bankruptcy by Feb. 15.

The new proposal would also release Mr. Ergen from certain liabilities in the case. That provision could prove a key point of contention for Harbinger, which is suing Mr. Ergen and Dish in Colorado over their actions in the case. Harbinger's $1.5 billion racketeering suit says Dish's and Mr. Ergen's actions cost the firm money and control of LightSquared.

Lawyers said Monday that the suit, along with Harbinger's suit against the U.S. government over an alleged breach of an agreement to allow it to buy LightSquared, may have to be resolved for this proposal to go through. Dish and Mr. Ergen, as well as a Federal Communications Commission spokeswoman, haven't commented on the suits against them.

LightSquared filed for Chapter 11 in May 2012 after federal regulators refused to clear its plans to launch its wireless network, which they said could interfere with global-positioning systems.

    Dish Has 1 Month Left. . .

Taz .. Tim F seems to think that Dish is asking too much and that ATT and Verz have passed on the deal .. leaving TMob/Sprint as the open option. Charlie points to the Fall spectrum sale for his valuation which is well after earnings .. I think Charlie has no prob avoiding giving any info at the earning heaaring .. he took 400m a year or more ago and never explained that!!

Anyone notice a HELD agains BLIAF and BLIBQ on nasdaq today? Nothing on BLIAQ, prob more mix ups!!

There are 2 Apps on the iphone .. there seems to be changes as of today on both. Might be something, might be nothing!!

BB on D app now requires an email ID and PW to log into. Dont have one so cant go any further to see if there are more changes, anyone? Prior to this, one was able to go straight in and browse for new releases etc..

BB App: up until y'day this app for months showed a netwrk error when one entered and you were not allowed to go any further. Today you can get past that and bounce around. This is the app with digital card and allows some old features like search for a store (could be changed to search for a kiosk??) and manage you By Mail account (just take the By Mail out and manage your cloud??)

    Why streaming?

    by mplecas7 Jul 3, 2014 12:44 AM

MP, I think it all comes down to a one size fits all solution .. right now there is not a complete solution to content where I can purchase a movie and watch it anywhere anytime. There is evolution in that direction but not complete. A complete solution would need to include in home verus out of home, payment, piracy and ability to upload/download for a mass market at low cost(Jerry has pushed a lot of info on upload/download and it's challanges) . I dont think NFLX has a complete solution, they have TV.DVR in home but I'm not sure that they have completed the Out Of home for all, they do have Android streaming (phone and tablet) but I dont have that and dont know how well it works and now the new challange of having to pay ISPs is a challange. There are DVRs out there that have BBonD but I dont own one and there is Roku too that BBonD is available on that I dont have. Maybe BB will be the first to make that cliam for a one size fits all solution!!

PS as far a LSQD .. maybe Charlie can bang out some long tern partership fees (low) as he goes kicking out the door.. for BB, it does not have to own LSQD, it just needs to use what it provides .. the LSQD business is based on making partnerships and letting them run their business over Sat without interference

Maybe Dish/BB will use the Satelitte download to Kiosks for video delivery(as jerry explained), maybe that will satisfy the Studio demand .. always thought that BB could have partnered with LSQD .. I guess Ergen wanted more control of the process so he went after the whole Co

    Ergen too might be motivated.

If he sold his spectrum for $17 billion, Dish’s shares could rise from $59.81, their closing price on Thursday, to roughly $70 a share, a source said.

Also, Ergen has until spring 2017 to connect 40 percent of his spectrum, or will need to return it to Washington.

It would cost Dish more than $10 billion to activate all of its spectrum.

Dish is presently rolling out a wireless fixed broadband service in Corpus Christi, Texas, that is rather antiquated and shows a lack of commitment to building a true wireless service, one source said.

Separately, in recent days Dish has postponed its annual meeting — and Ergen, in a little-noticed June 2 regulatory filing, updated his trusts. The update will allow, among other things, Ergen to dispose of his Dish shares in a change-of-control situation.

Verizon did not return calls, and Dish declined to comment.
