What happens to the 30% equity ownership that APAX already owns in terms of their thought process of walking? tks. Is it rolled into this investment or is this an additional cash investment?
What about the 30% equity stake by SKM. 7MM shares if APAX walks they will suffer ~70MM mtm loss on that. And then what do they do with their share?? So now its ~135MM hit to APAX to walk.
I think risk is more on the debt being placed, no warm and fuzzy feeling there other then the banks take a hit, keep it on their books and wait it out?
So your saying APAX can walk and just pay $66MM? It CAN sue the banks but it doesn't HAVE to? Won't RUE then sue both parties?
Also this is going into a new APAX fund, APAX VIII? They can begin collecting fees as soon as the deal closes.
But isn't it guaranteed by the bank? If they can't find buyers then they will take in on their BS no? Or get sued and pay 68MM in fees?
