  • Parsons claims that 8 years ago SIGA could expect to sell 14 million doses of a drug -- though they have sold only 1.7 million doses now and there are no RFPs out for more -- and the sale of just the 1.7 started a firestorm of media criticism (LA TIMES, NY TIMES, FORBES) and 2 Congressional investigations (Issa, McCaskill). At the time of the breach, which is when calculations are supposed to be made, BARDA did not even exist. Yet Parsons accepts Baliban's inflated value. These are laughable expectation damages that will be surely overturned by the Supreme Court. Only sorry that Jacobs has stepped down.

    If the Chancery Court decision goes against SIgA (see: Parsons), they will appeal to the Supreme Court again without a single doubt. The Chancery Court decision will not remove any remaining uncertainty. The Supreme Court decision will.

    Bouchard Nominated to Lead Chancery Court

    Bouchard, Siga's lawyer in their Delaware Supreme Court appeal, now becomes Chancellor of the Court where Parsons is now making his decision as a result of having the case bounced back to him. He'll have to deal with Bouchard on a daily basis. I wonder if that will temper his intemperance. Probably not, but it's a nice thought.

    1) SIGA is clearly not going to declare the income from the BARDA contract until the whole contract is fulfilled. They've said as much.
    2) This is pure fiction of the kind that the Delaware Supreme Court reprimanded Parsons for: "PIP's most likely outcome will be to get 50 percent of all revenue streams in the future, but possibly not current or past earnings streams." It comes out of your hat, which is a hat much like the one Parsons tried to wear.
    3) The margin on ST-246 is MUCH less -- and thus better -- than 35 percent.

    I don't spend much time on this board any more because it is dominated by name-calling jerks. But I wish the best to everyone else. And I'm still very bullish about SIGA's future, especially its Dengue future.
