Sooner or later Shah will realize he can't have an impact on CYD no matter what he does and he will take his profits and move on. If he sells his shares in an orderly manner CYD wont have any problems. If not your guess is as good as mine.
At this point Shah has made good money.
The kweks would not have vetoed all of Shahs proposal if there was going to be any resemblance of reform. Think about it.

40 cents in earnings for the third quarter won't hold the stock above $ 20 and everyone knows it. The pumpers are out in force trying to get the price up so they can dump it.
Don't be fooled.
Take your profits and buy it back under $ 20 after earnings are announced.

Seriously with only 40cents expected for the tird quarter and numbers weak in both July and August its time to be taking profits like the guys who know this stock have already done.
Another big Dow loser today is Caterpillar (NYSE: CAT ) , which is off by 2.12% after the company released data on its retail sales of machines for August, July, and June. The results, covering all of the company's major regions, were rather terrible, to be blunt. Caterpillar's machine sales worldwide for August fell 10% when compared to August 2012, while July fell 9%, and June dropped 8%. The worst performing region was Asia-Pacific which declined 30% in August, 28% in July, and 21% in June. The best region in August was North America which rose 1%, but had fallen 1% in July and 10% in June. From the looks of things, Caterpillar will likely report a decline in sales when it reports third-quarter results on Oct. 23.
