Logically there can only be two methods for Citron's acquisition of their Acthar "Sample" :
1. Obtained illegally !!!
2. It was NOT Acthar---perhaps it was RTRX's Retrophin in Acthar "clothing"... This wouldn't surprise me in the least since Left has been working with RTRX since the recent refinancing !!!
Right on target, but add no identification of labs, likely illegal acquisition of Acthar and all kinds of chain of custody issues...That's IF it really was Acthar in the first place. I'd take bets that it is RTRX's Retrophin where Citron has a stake and very close connections...Now wouldn't that be something (and the end of RTRX !!!)???
Or if Citron were properly short invested in H2O, there would be no H2O in Water in their attack piece on H2O :-)
I had a comparable realization not that long ago and posted it here. I had originally believed that the attacks were just trying to support an organized set of short positions (including options), but realized that it may be more than that as the stock breached into the $40's not that long ago. The battery of attacks had been formidable and Citron left us with a MORE TO COME message and then went silent. At that point the share price began a rather aggressive recovery ending at all time highs. Earnings came out and were more than respectable followed by analyst upgrades across the board. As this was occurring we were barraged by wave after wave of FUD announcements culminating in today#$%$ pieces from both Citron and Quoth the Raven, who are no doubt in active collusion. So I'm guessing that they not only profited from their short positions down to the high $40's but quietly went long as they went into silent hibernation preparing for this very successful assault. If this is true one could easily conclude that today or early next week they once again switch positions to long (especially using options) as they create their own short squeeze leaving all those who fell prey to their invectives in the dirt. And my hypothesis, as evidenced by the repeated attacks along the way, would conclude that they couldn't care less about what they say or how they say it as long as they profit from both directions over and over and over again. Thus far it appears to have worked for them as heinous as their actions may be...but a little bit of recognizing their patterns of behavior can go a long way toward protecting our investment in Q from the ravages of these games.
They (Citron and their various minions) have the same work ethic and protocols as some special forces. So credit due for an amazingly well developed and orchestrated SCAM... But it's STILL A SCAM !!!
First, these Acthar "samples" had to be obtained illegally as there is no way that they were voluntarily provided by Questcor...from there we have no idea what happened in whatever chain of custody occurred OR for that matter that what they claim was Acthar was ever company product. Who knows what was supposedly "tested" even if the labs were quality labs (hard to tell since they were intentionally kept anonymous). For all anybody here knows, the samples provided were RTRX's Retrophin !!! Now wouldn't that revelation be a kick in the pants and push Q right back to record highs :-)
This is pure red herring potentially to try to get QCOR to reveal things that they will NEVER reveal about their product or manufacturing process. Clever by the shorts?---SURE. Meaningful?---NOT IN THE LEAST!!! The ONLY WAY this would ever have any meaning would require a totally independent laboratory assessment of Acthar that was NOT commissioned by known shorts. HARD PHYSICAL EVIDENCE OF UNIMPEACHABLE PRODUCT...everything else has to be suspected to the maximum.
PRETTY AMAZING, EH??? And that his commentary, regardless of how well constructed...he's a PRO con artist, can prevail over truly professional analysts at credible firms is just astonishing to me !!!
Other than a direct liable lawsuit (which are already dicey), what's needed is SEC and Justice Department investigation into their trading activities tied to various communications. I would think that the evidence of fraud and securities violations would be instant and overwhelming!!!
The MINUTE they send out the COVER ALL SHORT POSITION SIGNAL!!! Of course they and their immediate cronies will already have covered. What is REALLY NEEDED is an active investigation of Citron's trading activities tied to their various hit pieces...And of course all documents, emails, texts, etc. subpoenaed by the SEC and Justice Department. It would be like shooting the proverbial fish in a barrel :-)
Ya know that does raise a very interesting question...How could Citron LEGALLY obtain Acthar without a prescription? Do people think that Bailey sent Left a vial to check it out himself :-)
Not per se, but this kind of FUD goes viral as people cut and paste and repost all over the place. What is absolutely astonishing is that Citron/SA's piece was debunked by virtually all PROFESSIONAL ANALYSTS versus Andrew Left who is a well known con artist!!! So ask yourself why on earth would people buy into his fabrications versus hands on analysis by some of the top biopharma analysts on the street? Fear only works in the short term, which is why it is important to review ALL of the SHORT ATTACKS over the past couple of years, look at the short term impact and then the overall success of QCOR share price. Their attacks are not meant to have a sustained impact...they are long since covered (and likely LONG) by the time their attacks have been revealed as nothing but hocum. But as PT Barnum said, there's a sucker born every minute and these guys are professional con artists preying on those who don't have the wherewithall to last through their attacks for better times that ALWAYS OCCUR !!!
And all your doubts about Citron's intentions and ability to prevail over more than a few days will evaporate instantly!!! Several others have experienced similar declines only to hit record highs...Uh, JUST LIKE QUESTCOR HAS DONE OVER THE PAST 18 MONTHS :-)
If Citron's allegations are true and they have known (and reported to the FDA) of these infractions and all the other assertions or allegations that have been heaped on QCOR why has there been ZERO LEGAL ACTIONS with Don Bailey doing a perp walk? Answer, because NONE OF IT has been anything other than alleged with NO SMOKING GUN!!! Imagine how you would feel personally if a similar set of attacks were levied at you and your business or career, and yet Bailey has sustained his cool every step of the way.
There will NEVER be a Bailey perp walk because every ounce of these attacks have been fabricated!!! But if you have doubts just take a look at the 90 day, 1 year and 3 year charts and map all the deep dips directly to similar (albeit not as creative) attacks while the overall performance and share price trajectory has been nothing short of incredible...

Acthar is a complex mixture of peptides, with the majority being non-pituitary derived that function to extend the PK profile of active melanocortins
ACTH is one of many pituitary derived peptides in Acthar, and thus would likely represent a small fraction of the peptide mass
It is logical that QCOR has active ongoing dialogue with the FDA regarding the composition and diverse functionality in Acthar
