They can't reply because it's not in the script! Blah, Blah, Blah ... OSIR is toast, OSIR is an embarrassment! Meanwhile, the share price continues to float upward?
We're a year further into clinical studies and results ... this presentation will do more to get the word out than any of our salespeople can. Great timing ... bring on the revenue!!
Yes, there had to have been shares sold, however, the MMs can collect them and them dispose of them in orderly way at a prearranged price. Just sayin'. They were probably shares stashed from lower prices and now sold by the MMs for a profit. Hey, they have to eat, too!
Nice recovery ... I had to leave this morning just as they dropped it to $4.40 and fully expected to return home to a red pps. Holy volume!! They did the opposite of the spike and slow fade, I see. Thinkin' there' s some
some news? It always seems to move ahead of it, good and bad!
The beauty is that we were taking market share BEFORE Osir's study confirmed disparity in efficacy between dead skin and us, so how is Pete going to show Osir defamed them and caused financial harm?
Plaintiffs asserting a Lanham Act claim for misleading but true statements face a higher burden: They must typically show extrinsic evidence—like a survey, for example—that demonstrates the misleading effect of the advertisement.
4.A statutory cause of action is also presumed to be limited to plaintiffs whose injuries are proximately caused by violations of the statute. A plaintiff suing under §1125(a) ordinarily must show that its economic or reputational injury flows directly from the deception wrought by the defendant's advertising; and that occurs when deception of consumers causes them to withhold trade from the plaintiff.
So, Pete is going to have to prove that the decline in sales/revenue is directly a result from what OSIR has purported and not because hospitals/clinics/doctors/gov't have simply found a better product. Since OSIR's recent statement is well after the fact of decline, Good Luck!!
And, yet, OSIR is continuing a slow climb and MDXG a slow ascent. How would you explain THAT after the CEO bought shares and the company has bought back shares? Ponder it, just for a moment in your parallel universe.
Let's see what today shows ... I saw a 10K bid at $4.36 when we were at $4.39 (some support?) and now someone has thrown a 7600 block at $4.45. Let's see if THAT ask gets "slapped"?
Might want to be careful where he's shining that investigative "light" ... there are skeletons in his closet, too!
Pete better save some of that cash being spent on legal fees for more share purchases and stock buybacks! He's pulling ALL stops, and the share price is under $7! Hmmm ... who'd a thunk it?
"Me thinks thou doth protest too much"?
But, we NEED to break thru that high six range ... finally, or it's just another wash, rinse, repeat for the short bashturds!! CEO debacle was all they needed, but the tide is turning fundamentally with the company, so I'm hoping this will be the time we climb back towards the actual price targets in place. GLTA
