If I am PW, as the defendant, I would go for a 'jury trial'. The David vs Goliath story normally spins well with the average jury. We shall see, shortly!

Nervous market. PW is like watching paint dry. One has to assume that the arbitration process is underway as previously agreed with the judge. Likely not legal or ethical to report to public on progress (if any) in the arb process. It is no more than part of the normal legal process, particularly, in a civil case. Unless there is an incentive by one or both parties to get the case settled, it often does nothing more than prolong the case. I would imagine that PW is not likely to settle during arbitration, unless, there is an incentive (reasonable offer from NFS/WLE) to do so. The judge who is handling the arbitration has no legal authority to make a judgment or force a settlement. Both parties are reminded that going to court is the alternative and someone is going to lose if that happens. Courts prefer arbitration settlements, but, they cannot be forced. Usually a weak-hand is more anxious during arbitration. I very much believe that PW is the much stronger hand, here. Going to court is likely better for PW than NFS/WLE. IMHO
