Potential answers. I'm not sure what the ceo needs 300k for. If it isn't anything pressing then i'd def cancel the upcoming fundraising deal and modify it significantly or cancel it all together. You now have the trial schedule laid out and with the stock price being where it's at to do a floorless convert is not a smart move. I'm sure given the potential of WDDD you can find better terms and smaller amounts to get you through the coming months for when you get closer to trial and more beneficial possibilities of a possible settlement.
Toproller or whatever his name obviously has an agenda. No position and yet he's posting like a mad man trying to get the stock down. He's either representing a short or someone who wants the stock down. It's a otcbb so you can't short it retail wise. Maybe Activision is behind it, maybe it's a mm who's short or maybe someone else. Highly unlikely it's a hedge fund as it isn't liquid enough to get in and out of, no options to hedge and it's a otcbb which they never play in.
There is a potential financing package on the table, but my guess is it can be terminated or modified. The CEO has done it before and my guess is he'll postpone it or modify it if need be.
I think some retail and they are very stupid are upset about the duration of the trial schedule. The reason they are upset as they are stupid and don't know how IP litigation works. The Nov one day trial to hear this ridiculous motion will be dismissed by the judge as soon as it's heard. WDDD, has a top tier law firm representing them at their cost not WDDD's. They get nothing if they don't win. They spent a long time going over all the specifics surrounding the validity of the patents before agreeing to take the case. There is no prior art here or patent concerns to worry about other than the PTAB doing their typical dance, but that's and endless back and forth and by the time that ever gets finalized we will have some more patent friendly legislation and Supreme Court precedents that are more patent holder friendly.
So, there are some dilution concerns, but my guess is they are handled by the CEO and modified. There is no corp overhead so it shouldn't be much of a problem. Activision could throw in the towel at any moment, but that's probably a bit unlikely at this stage.
I'm not a lawyer, but I've been a sell side trader for a international bank, a buy side trader for a hedge fund and a portfolio manager for a hedge fund. Been in the equity markets for over 20 years. Take my advice or don't, i could care less. The tactics are obvious. If you have the facts on the side argue the facts, if you don't you use stalling tactics. What path is ATVI taking in your opinion.
I love all these posters that come out on down days to try and take advantage of a .02 sell off. How much volume did we print yesterday? 178k shares, at .10 equals a whopping $17,800. Man oh man, that's one huuuuuuge sell off on huge volume, isn't it? The retail audience in this stock needs a lesson in market and IP litigation history.
The investorhub message board is a much better board, but I have to say this. The posters on that board with very few exceptions have to be the most inexperienced, remedial investors I have ever come across. The stupidity levels of the posts is off the charts, not only that, but everyone wants to be told what's going on instead of doing some work themselves.
Listen up people. There is absolutely no chance ACTI gets a summary judgement on the motion they filed. If you know anything about IP cases the strategy is delay delay delay. I'm not saying that delays can't happen, but there is zero chance this case gets thrown out before it starts. ACTI, know it stole the tech. Susman Goodfrey knows they stole the tech. This is just a matter of if, not when. Obviously a jury trial can come back with anything, but I highly doubt this makes it to trial.
Hudson seems to be done selling stock, but there seems to be a seller, maybe it's retail, maybe it's a MM, but this should be heading north very shortly. The only thing that is truly relevant right now is when will the trial be scheduled for. Maybe we find that out soon maybe we have to wait a bit more, but I am much more comfortable waiting while it moves up now that Hudson is gone. Stop panicking people.
