    Well the fundamentals don't match share price. The current reaction is to the appeal and massive manipulation on the buy and sell with 1 share and 100 share trades common.

    The company reported recently that revenue has increased QTR 1 by 25%. With a previous burn rate of 2 Million a QTR. The 25% increase reduces that to 1 Million. With 3 Million in cash assuming they can maintain or improve on 25% they can operate until Feb 2015 and probably beyond. I bet they improve there revs over this period and finally exceed expectations and are taken out in a buy-out.

    The share price has very little to do with a buyout. That's why people make money in stocks. Valuations shift wildly with perceptions. The facts are the company is on track to produce 35 Mill in revs. It is also recognized that 10X revs is common buyout metric. You can quibble over 5X versus 10X but your dribble about the share price is insignificant to a potential buyer. Take Richards Group, a company that has years of experience in marketing and knows HIPP. A mobile marketing component to their existing 1.2 Billion dollar business would make a lot of sense and within a larger expanding market make them a lot of money.

    Furthermore a perspective buyer like Richards Group at 2.00 a share HIPP is a bargain within the framework of a larger organization which can scale the business overnight.

    From a potential buyout perspective: If Hipp simply performs at 1Q proven 25% increase in revenue 2Q they are on track for 35 Million in yearly revs. At 10X rev buyout thats a 2.00 share price. A believe a perspective buyer (like richards group) is waiting for two things the Yahoo ruling and 2Q revs. With a positive ruling the buyout would be higher. Since it wasn't were only waiting on the 2Q results. If HIPP maintains or exceeds 25% I think we see a buyout near $2 bucks.

    Bigdaddy,

    This was only one appeal for augme vs yahoo regarding augme's patents. There is no cost and no relation to Yahoo's patents. The appeal was only lost on one point all others were conceded to Augme. Basically, the evidence and testimony was not sufficient for a jury to determine material fact regarding the way prong of the three pronged Doctrine of Equivalents. The only evidence missing was expert testimony describing in detail why embedded inline code is effectively the same as retrieved code or partially embeded code. Other than that this might have turned our differently.

    If anything this reduces monthly costs to HIPP above the contingency agreement. So on a revenue basis this will add to the bottom line.

    I don't know when. However, my view is that most appeals are not granted. The appeal weighs in Hipp's favor and is evidenced by the longer than usual ruling. I suspect we have one for and one against and one on the fence who based on the hearing will lean towards in their own words: "isn't this an issue for a jury", sending it to trial.

    The stock is highly manipulated by active traders since the interest has dropped. When interest picks up this strategy of giving away 100 shares over and over to lower the price will not work and the price will move up quickly.

    I agree with you and think the whole thing stinks. However, the appeal on it's face to the district court did not mention the attorney misconduct and I am only comparing the facts of that appeal to augme/yahoo and think we have a better chance based on the facts presented.

    I do agree with your thoughts of how corrupt the system is. Also, leader lost the appeal and appealed to the supreme court who chose to not hear the case. They recently presented to select congress representatives a long winded document that accuses all of the Judges, attorneys and the rest of misconduct so far so that I believe they will never get justice.

    Well, I read more and listened to the oral arguments on leader/facebook. That appeal is based on a completed jury trial. The Yahoo appeal is not. Also, though I believe leader's patent was infringed as did the Jury on 11 counts. There was special circumstances of prior sale of the patented code that can be construed as prior art if true. Completely different situation, however, I understand how unpredictable this can be. I just can't help thinking that in the leader/facebook case there was some evidence to deny the appeal especially since a Jury ruled on the case. In the Yahoo case it seems like there is less substance to sway the panel of Judges and compelling evidence to send it to a Jury.

    Read a few articles on Leader/Facebook. Very disturbing how or judicial system is unreliable, however, it was shown that two of the Judges financial disclosures showed they stood to gain financially with a favorable Facebook ruling. Hopefully our Judges have better ethics and moral character.

    Listened to Appeal over and over. I initially believed it was a 50/50 chance of granting appeal. After listening over and over I am convince it's more like 75/25 in favor of granting Appeal.

    Simply there were two issues. The indication of permission by yahoo's ad's denying or granting the ad. This clearly went to Augme(HIPP). So for me the issue came down to the topic of the WAY prong within the Doctorine of Equivalents. In other words is there enough factual evidence that a jury can consider to establish that the WAY yahoo networks serve ads is the same WAY the patent claim describes the process. For me based on the way the judges questioned both sides and provided citations for review I'm leaning 75/25 benefiting Augme's(HIPP's) position and the granting of the Appeal.

    The fundamental concept is basic programing 101 in that inline code is compared to the same code where calling is used to build sections of code and when compared to the executable line by line they are the same and thus the same WAY.

    So, what happens when the Appeal is granted?

    I don't see how anyone can say there worried about dilution. Recently the company stated that they were on a 500k monthly run rate which means they need 6M additional Revs to break even. 25% YOY Revs increase translates to yearly increase of 6.675 M which means if they truely hit 25% YOY there break even this Qtr. which will report very soon!

    NO DILUTION! They stated on the call have $3M in cash and $2M in available loan. Total $5 million without new REV would allow them to operate for 10 Months. They should be cash flow positive by then if not sooner. Amazing you have no facts, don't listen and spread dis-information.

    DON'T THINK SO! They state on the call that they signed up major new clients - a large beverage company, food company and a tech company. What call were you on? The also reported reduction in revs. directly related to new regulation which they worked out and is behind them. Also, they are projecting 25% increase for REVS in 1 QTR this year and anticipate accelerating Revs for the year.
