Excuse me bubs, but I said exactly why the ATM was bad. You tell people what they want to hear, not what was said.
No, that's not insider trading at all and a very common practice by financiers. They profit both ways. Having to resort to this kind of financing (I told everyone here how bad it was when first announced) tells me the company is doing a horrible job in getting institutions interested, let alone excited.
I can't believe they're doing this, but I can almost guarantee you they are. This explains why Cowen (or affiliates) shorted over 1 million shares the week before the ATM announcement, as they knew the company was ready to dump stock. If NVIV at the time would have told Cowen they weren't going to dump stock for at least a few months, those shares would NOT have been shorted right then and there. You might ask why stock is being sold below $10 and it's because at this level, they know they can sell a lot more and meet their needs quickly. IMO, they already have plans for this cash and want it quickly. Am I right ? We'll know when the next 10Q comes out. I still hold my $11.50 and $9.72 positions and will continue scaling in at approximately $1.75 intervals. My positions are extremely light since my confidence in this management team has dropped to new lows, but there's no doubt the scaffold works. It's just an absolute shame that management didn't do a normal raise at $14, which they should have been easily able to do at the time they made the ATM announcement. Amateur hour deluxe and still scratching my head. The easy money has been made here and future trading profits will be earned the hard way. The momentum was gathering steam and management killed it big time. And since management told shareholders at the shareholder meeting that they read the message boards (just insane), I hope they read this ..... Get off your tails and make good investment banking relationships, not this pink sheet stuff with the likes of Cowen. Operate your company as if you actually believe in it. And get some REAL institutions involved.

I have no doubt that there were many many retail lemmings that just got flushed, some of them by their brokers. A ton of margin calls all across the market, so after they are ultimately washed out, NVIV should start to climb back up.
Why is that ? Well back out the one-time non-cash charges from the 10Q and you'll find a company that's now cash flow positive. Glad to see people are actually able to start connecting the dots.
Although the company would never admit to that, it makes some sense, as why would Cowen short over 1 million shares a week before the ATM announcement if the ATM wasn't going to be used right away ? Companies have done this before in order to get tutes in and flush out retailers. No opinion either way, but it's certainly possible.
Important to scale in and spread out your purchases.
