    I guess it comes down to average cost basis. Those in at $6 or more very likely not. Tmbiogen in at under 30 cents a share could make a killing. I doubt that the exact date of October 31st will be significant.

    True I live in Boca Raton Florida. No interest in shuffleboard. Perhaps you have thrown in the towel. Plenty of volume today. I do know our attorney Eugene Licker is fighting decertification and has pledged the use of dual auditors. Extensions on the October 31st date can always be granted by the SEC if progress is shown. A member of the CBEH Investors group confirmed he has heard of the new auditors by would not disclose their names. The dismissal of class action status for the plaintiffs recently has to be a huge plus for CBEH. Nothing is set in stone until actual news releases by the company for all to see. I'm betting the news will be good.

    Looks like this case could be over. The attorneys for the plaintiffs have racked up thousands of dollars and hours so far. They should see the writing on the wall and cut their losses instead of filing actions for individual plaintiffs such as the Puerto Rican Teachers Retirement system. Their whole case was a house of cards anyways based on the fraudulent stock manipulation of Jon Carnes/Alfred Little.

    Obviously we won't recover until audits are released. Our attorney, Eugene Licker has been very responsive to investors and has a 10 page plan to become current by October 31st using dual auditors. The plan appears to have been favorably received by the SEC. Toby Grand has all his shares still. CBEH with its hiring and plant expansion plans is certainly worth much more than its present share price. The investor psychology reflects the SEC action but will change dramatically when CBEH delivers. IMO the risk/reward ratio for CBEH has never been better as the stock is insanely cheap.

    For CBEH it would be completion of 2009 reaudit by RBSM, also the 2012K and 2013K by the new auditors. Then I assume the 10Qs for the first 2 quarters of 2014. We would stay on the pink sheets until application and acceptance by NASDAQ which was the stated goal at the last annual shareholder meeting last December. Other criteria like share price over $2, number of shareholders, profitability levels and total valuation must also be met.

    It is confirmed by SEC response filings and by our attorney Licker that we have new auditors working on getting current since this May with a target date of Oct. 31st, 2014. Licker believes that the SEC will accept his plan and will delay any sanctions against CBEH until then.

    I have read the entire 10 page letter. It explains how CBEH got in this position after he short sellers attacks and the criminal allegations against Jon Carnes. It explained in detail the reason for the change in auditors and in the case of Sherb due to issues unrelated to CBEH and outside of our control. They made a good case for becoming current by the end of October and are sparing no expense in hiring additional auditors with greater capacity to complete them as soon as possible. They pleaded that the sanctions would cause even more harm to investors. Remember CHBT was decertified but didn't keep their deadlines and took over 2 years. This will not be the fate of CBEH in all likelihood. I am eagerly awaiting the announcement of who our new auditors are. If they have the means to complete on schedule we should be just fine. As CBEH appears to be hiring the book value could be in excess of the last reported $4.50 a share approximately. We are currently trading at less than 1/15th of that. Market psychology is everything. The risk perception could evaporate very quickly.

    I really don't think so without starting an international incident. Check SCEI as to what could happen if that occured. Rally not going to happen. Stock down on the uncertainty but will recover upon release of earnings.

    I am still bullish. As long as they retain RBSM as our auditors the figures will be released in time to save us from decertification which is putting negative psychological pressure on our stock. The amount of time to deliver the first 2 years of 10Ks , 7 months would suggest they next batch or all back reports is due fairly soon. The risk/reward ratio has never been better is the figures are good, there is a book value of about $4.50 a share with lots of cash on hand and no debts as long as the financials are delivered promptly. The SEC has a history of working with companies if they can deliver in a reasonable amount of time which would be in the best interests of shareholders. We were not singled out. Four other companies not current on their financials were part of the same action against CBEH and share the same July 29th court date. Hoping also the judgement for class certification the the class action suit will go our way. The plaintiffs may be unable or unwilling to make a provable case against us on the merits of the case and result in a dismissal of the class action altogether. This is on the docket tomorrow July 10th.

    You are way off base! Case in point CHBT who got their initial notice from the SEC Oct. 7th, 2011. They did not even have an auditor until early 2012. They contested and were finally decertified. Nov. 4, 2013 a full 2 years after original notice. They had other legal issues unique to their case. Our auditors, RBSM have been working for us since June 2013 and have already delivered 2 years of 10Ks in 7 months released last January. Completion and release of more 10Ks could come soon though of course Investor Relations is not at liberty to divulge the timetable. Even if we are temporarily suspended that could be lifted by becoming current. CHBT eventually became current and have appealed to the SEC to regain its registration. Your baseball analogy runs afoul of logic.

    Yes I would hope they settle on deadlines to release financials which are likely near completion. CBEH wouldn't waste their time and money on the court case, annual meeting and already published financials last January if they didn't intend to get relisted. Even if we are unfortunate to get a suspension it would be lifted once we get up to date. They are replying to the SEC order posted on the sec.gov site ending with the numbers 1566.pdf

    CBEH is contesting the SEC order. They can work out a plan that if agreed upon can avoid suspension or decertification. It is up to the SEC. Court date on this matter is July 29th with pretrial motions done by teleconferencing. July 12th next court date for class action lawsuit where the plaintiffs are compelled to prove the reason for the lawsuit and is the deadline to deliver demand for discovery to CBEH which they failed to do recently. The judge will rule on certification or non certification of the allowed or disallowed members of the class of plaintiffs.
