    I really don't think so without starting an international incident. Check SCEI as to what could happen if that occured. Rally not going to happen. Stock down on the uncertainty but will recover upon release of earnings.

    I am still bullish. As long as they retain RBSM as our auditors the figures will be released in time to save us from decertification which is putting negative psychological pressure on our stock. The amount of time to deliver the first 2 years of 10Ks , 7 months would suggest they next batch or all back reports is due fairly soon. The risk/reward ratio has never been better is the figures are good, there is a book value of about $4.50 a share with lots of cash on hand and no debts as long as the financials are delivered promptly. The SEC has a history of working with companies if they can deliver in a reasonable amount of time which would be in the best interests of shareholders. We were not singled out. Four other companies not current on their financials were part of the same action against CBEH and share the same July 29th court date. Hoping also the judgement for class certification the the class action suit will go our way. The plaintiffs may be unable or unwilling to make a provable case against us on the merits of the case and result in a dismissal of the class action altogether. This is on the docket tomorrow July 10th.

    You are way off base! Case in point CHBT who got their initial notice from the SEC Oct. 7th, 2011. They did not even have an auditor until early 2012. They contested and were finally decertified. Nov. 4, 2013 a full 2 years after original notice. They had other legal issues unique to their case. Our auditors, RBSM have been working for us since June 2013 and have already delivered 2 years of 10Ks in 7 months released last January. Completion and release of more 10Ks could come soon though of course Investor Relations is not at liberty to divulge the timetable. Even if we are temporarily suspended that could be lifted by becoming current. CHBT eventually became current and have appealed to the SEC to regain its registration. Your baseball analogy runs afoul of logic.

    Yes I would hope they settle on deadlines to release financials which are likely near completion. CBEH wouldn't waste their time and money on the court case, annual meeting and already published financials last January if they didn't intend to get relisted. Even if we are unfortunate to get a suspension it would be lifted once we get up to date. They are replying to the SEC order posted on the sec.gov site ending with the numbers 1566.pdf

    CBEH is contesting the SEC order. They can work out a plan that if agreed upon can avoid suspension or decertification. It is up to the SEC. Court date on this matter is July 29th with pretrial motions done by teleconferencing. July 12th next court date for class action lawsuit where the plaintiffs are compelled to prove the reason for the lawsuit and is the deadline to deliver demand for discovery to CBEH which they failed to do recently. The judge will rule on certification or non certification of the allowed or disallowed members of the class of plaintiffs.

    The court date was removed from the calendar. The lead plaintiff Puerto Rico Teacher Retirement System has until July 10th the satisfy our request for demand for discovery with records showing production figures were false. Since the original case was filed based on the the allegations of fictitious Alfred Little(a/k/a Jon "Fatty Boy" Carnes) currently under indictment in a Canadian court there is a good chance such documents cannot be produced and their case could fall like a house of cards.

    The first year he was head of the independent audit staff. The next year he was engaged as just a board member. He is now a professor at Lake Forest Graduate School of Management in Chicago and appears to have resigned from all of his board jobs in China according to his Linked In resume.

    SCEI is trading on the pink sheets and this judgement was rendered against them. The attorney/shareholder who won the judgement has shares in CBEH is not happy. I for one hope the audit results are released very soon so as to put this to rest. Rem non spem, factum non dictum quaerit amicus.

    Markschied's salary was cut in half after he became just a member of the board where the first year he was the head of the independent audit committee. About two months ago I got an email from Linked In to congratulate Steve on his new position as professor at Lake Forest School of Management in Chicago. We are connected on Linked In. Perhaps Steve wanted a position without so much travel. His resume says he also works for Wilton Partners and Mammoth Industries. It sounds like he is not going to be on any Chinese boards and he left by mutual agreement. He lists China Integrated Energy as a former position.

  • Case in point SCEI which a group of shareholders won the right to control the company and liquidate their assets for the benefit of the shareholders as they hadn't reported since 2012. This was in a Nevada court. The receivers expect to get many times the current value Sino Clean is trading at. The judge noted that the company needed to be in compliance with the charter rules when listed through reverse take overs. Among some of the larger shareholders of CBEH there is at least one attorney that has the knowledge to do the same for the shareholders of CBEH if they don't release figures soon. We are getting very tired being told that the auditors are still working on it month after month with no forecasted date of completion. It is good to see that US courts are standing up for the rights of shareholders of foreign companies listed here that have appeared indifferent far too long to the rights of their shareholders.

    I saw recently on Linked In that he took a teaching job in the states. At the time I thought t would be nearly impossible for him to keep his commitments on the various boards he serves on. I believe it is just a personal decision to find a new challenge that involves less travel.

    According to Investor relations and board member Markschied RBSM are working steadily towards completion. Some theorize they are holding them back until the wrap up of the class action lawsuit. Next motion for class certification is just 5 days away. Looking up the auditors online suggest that they have a very good reputation and I would not think they would tarnish it by looking like they are unable to complete the audits in a timely manner. Remember the sanctions against former auditors Sherb caused extra work as they have to do 2009 figures again too. All said I expect at least some figures to released within weeks and could come at any time now.
