    Hong Kong‘s securities regulator the Securities and Futures Commission, or the SFC, has begun its first legal action against famous activist short seller Citron Research for issuing a “false and misleading” short seller report on Chinese property developer Evergrande Real Estate Group (3333.HK) and profiting from the companies’ share drop, The Wall Street Journal reported. The commission said it would pursue Andrew Left, the head of Citron Research, through Hong Kong’s Market Misconduct Tribunal, an independent body overseeing allegations of price rigging.

    According to the allegation, Left short sold 4.1 million shares of Evergrande before issuing a short sell report on June 21, 2012, which caused shares of Evergrande fall by 11.4% that day. Left made a total realized profit of 1.7 million Hong Kong dollars ($218,000).

    Citron Research was known for targeting Chinese companies listed in the U.S. in 2011 and 2012. Its short selling reports have caused companies from China MediaExpress to China Valves Technology to de-list. But the research firm’s focus in the last year has shifted back to U.S. stocks. It has a Short opinion on Telsa (TSLA), NuSkin (NUS) and Angie’s List (ANGI). Most recently, it called Textura (TXTR) a “fraud” with $4 price target and GoPro (GPRO) a “convenient fiction” with $30 price target.

    This is probably the biggest positive news since Carson showed up as it will mean 1 - now by association Muddy Waters credibility will be questioned and 2 - the whole fraudulent process will have some light shone on how it works... SEC where are you?

    Now that there is a clear date of when that visibility will come expect a run up prior to the 18th, after that is anyones guess.

    I am picking the total clarity when these filings are done and the stated company buy back and insider buying will sustain a higher share price over the next 6 months. REMEMBER - neither the company or insiders have been able to buy until these reports were filed.

    The numbers to me are less important than to see the strategy and scalability of what they are trying to do.

    Oh and BTW before any of you trolls start with the FUD strategy again don't waste your time as you have all been long consigned to IGNORE ;-)

    Stop spreading lies it was stated they wouldn't be buying anything back until after the deal is done as illegal under market rules. Problem is Matt and co were announcing the buyback the week before they then came out and said the deal was on the table and for now that couldn't happen. I have asked Mathison to address this, he now refused to reply to my emails. Pretty legitimate question, front up and answer it or I will keep raising it here.

    It seems NQ Mobile has the money to pay for it. As of the end of September, the company sat on $278 million cash and short-term investments.

  • He has now received 2 emails from me asking him to explain why they were pumping the buyback the week before they announced this deal was on the table and therefore the buy back could not commence. This is a legitimate question and he refuses to reply.

    Are we meant to believe this deal showed up in the last week before the announcement? Or was this just a case of them not knowing that what they were intending to do would have been illegal but no one consulted the lawyers before they put out PR confirming an aggressive buy back by both the company and insiders?

    Either way its a stuff up and the lack of an explanation makes it even more of a stuff up. Have you not learned anything from previous communications stuff ups? I am going to keep asking this question and the longer i don't get an answer the more you will have wished you didn't ignore the first time i asked!

    Carson you are next... its time your own credibility got the attention you have brought to NQ. Just about nothing this piece of human waste has said has come to fruition or been proved. Despite this Bloomberg and others just keep parroting this same rubbish and never ever report on the facts of what this joke said vs what has actually been proved or disproved. Its pathetic... for example "NQ has no cash" the biggest lie of all and absolutely no scrutiny - try go asking Carson to repeat that now and justify and defend this OUTRIGHT LIE! Time for the filth to go to jail - SEC do your job you useless overpaid lazy corrupt fat cats!

    They didn't get any information, its just part of the FUD strategy. Its pretty clear what the situation is with the buyback, whats not clear is why they were announcing this aggressive buy back up until a week before they then turned around and said the lawyers have said we cannot do it until the deal is done. So either NQ were announcing something they knew they could not execute a week later or no one asked the lawyers. Either way thats a major stuff up and their blank refusal to address questions around this is unacceptable and concerning.
