    Not my idea, but I couldn't agree more. Every time we see $10 we have traders taking profits, I see the stock holding in the $7 to $8 range until they drop the bomb, then one big jump. The day traders dream is over for now, you either believe in the science and are invested, or you get frustrated and sell. As for me, I am totally fine waiting for the big jump after marketing and sales begin, a great time to add if you can. Thanks for the wisdom from the original author, you know who you are. RSR

    Hart–Scott–Rodino Antitrust Improvements Act

    When the notification is required

    The general rule is that a filing is required if three tests are met; (1) the transaction affects U.S. commerce; (2) either (a) one of the parties has annual sales or total assets of $151.7 million[2] or more [as of 2014- in 2012, this threshold amount began increasing periodically under the law], and the other party has sales or assets of $15.2 million[3] or more [As of 2014-this amount adjusts periodically] (where an acquired person is not engaged in manufacturing, only its total assets, not its sales, are counted, unless its sales are over $151.7 million[4]); or (b) the amount of stock the acquirer has is valued at $272.8 million or more [As of 2012-amount adjusts periodically] at any time; and (3) the value of the securities or assets of the other party held by the acquirer after the transaction is $68.2 million or more [As of 2012- amount adjusts periodically].[5]

    The HSR Rules state that if Al is not engaged in manufacturing, only his total assets are counted. Now that MannKind is about to become a manufacturer, the fee will be based on sales.

    Perhaps because Al knew a change of status was coming, could the filing be delayed to reduce the amount of the filing fee? Can anyone untangle this legalese and make some sense of it for the layman? Less

    Speaking for myself, MANNKIND HAS NEVER DSSAPPOINTED ME AS A SHAREHOLDER
    I initially bought MNKD 2years ago, I have watched the stock go from $2.80 down to $1,87, back up to $8.70 on positive phase 3 trials, then back down to $3.0+ with the announcement of the ADCOM. Then the stock rode at $5.0 for an entire winter. The stock slowly climbed to $6 and bounced between $6.0 and $7.0 heading into the ADCOM, after the ADCOM the stock was strong for a few days until the delay was announced. The shorts talked about it tanking to $3.0 due to dance pharma, didn't happen, instead the stock began to climb, it actually flew past $7.0 and $8.0 I hardly noticed those numbers. Prior to FDA approval we were at $10.75. We now have a Global manufacturing deal with amph, and a Global distribution deal with Sanofi. If they couldn't get it down to $5.0 during the delay, why would you think they could do it now. This is "The Beginning" not the end. I wish every long well in this stock, and I believe you'll get it. Just want everyone here to know, I am NOT dissappointed with Mannkind, and I'm NOT dissappointed with the deal, we only have to wait now, the hard work is over. Good luck to all.     Step 1) October 14 2013 Mannkind files the NDA that was drafted by the FDA for possible appoval of Afrezza.
    Step 2) The FDA acknowledges the new NDA filed by Mannkind.
    Step3) The FDA schedules an Advisory Committee to discuss the safety and efficacy of Afrezza.
    Step4) The ADCOM panel of Diabetic Royalty was assembled by the FDA.
    Step 5) The ADCOM members vote unanimously (27to1) to approve Afrezza.
    Step6) The FDA issues a standard 90 day delay to analyze the data of the ADCOM.
    Step7) The FDA approves Afrezza earlier than expected.( June 27)
    Step 8) Mannkind and the FDA hash out the clean label for Afrezza.
    Step 9) Mannkind secures a 5 year Global manufacturing deal with AMPH Pharmaceuticals.
    Step 10) Mankind secures a partnership deal with Sanofi to distribute Afrezza, Sanofi has a diabetes sales force 50,000 strong, in 120 Countries and I won't even mention the split and money.

    Afrezza's fate will now be in the hands of the Diabetic population all ove the World !!! We have cleared the last hurdle, the people who count will get to decide the fate of Afrezza. All we have to do is wait a little longer and the people will let us know our fate, we are going to market with one of the major Diabetes Companies in the world. How can anybody not see this as positive ?? Mannkind, in my opinion, did everything they could do, and they did it very well. No BP has ever successfully pulled off what Mannkind just did.

    As Sanofi prepares to launch Afrezza, Mannkind Technologies will be conducting studies for future applications of Technosphere. Just give it a little time. We won, the long term vs the short term will pay.
    We have waited this long, what's a few more months to get it done right. Good Luck too all Mannkind longs. RSR Less Less

    Just a not so clever investor, I learned of Afrezza in June 2012 when it was around $1.50, did a little research and invested only to show support for the diabetics. In @ $2.40, $2.80, and added a few times around $5.0. Already doing very well, expect to do extremely well after the soon to come launch. Funny how when you do something to help people, it usually comes back 10 fold. Happy to be mnkd long. RSR

    You're probably right, when it came out here on YMB that mnkd was having a surprise CC @ 5:30 on the 11th, it did absolutely nothing to premarket.
