So here is a question for you:
Since it would appear as though various institutions are buying most of the stock that comes on the market;
DID SHORTS JUST CREATE ANOTHER 400,000 SHARES THIS MORNING IN THEIR CONTINUED EFFORT TO BURY OUR PRICE? Did they just dig a slightly larger hole for themselves?
Some of this must be AVNR sales, some may be retail longs though I highly doubt it.
We will buy whaver you sell. Dig your own grave.
This is based on my own belief that long term retail is not letting go of it's shares.
For me - the unknown is how much of the institutional accumulation can be explained by AVNR's continued sale of shares on the market. Are there any gurus out there with a better calculator than mine?
R U trying to burst my balloon? On President's Day? Cruel.
An here I thought I was in the Driver's seat.
With all of these recent decisions that seem to be on-point, it appears as though there are a lot of reasons for a judge to hold his fire until the lay of the land is clear
BOOM BOOM BOOM
I'm going to risk an opinion regarding what Judge Stark is pondering.
Whether or not to ward punitive damages to AVNR, and if so how much.
Question for our experts: Are AVNR's attorneys' legal fees already in the record for any reason?
This is based on an empirical formula based on bending over for over 12 years. My perspective isn't what it should be.
Also based on this happening this Friday where sales pop of 20% is announced and five business days later another pop of 20%.
I agree Frank - for some reason, this is different. Maybe it is just AVNR starting the process of pre-reporting, maybe they are setting up an effort to free ourselves from the grips of these shorts. But at least it is good and it is different.
Assuming this is the decision they are waiting to make; which isn't clear to me yet:
They are waiting for clear victory. I always pooh-poohed this patent lawsuit, but until it is won decisively it represents a threat of complete emasculation. These guys have bought in already, so they probably have the same opinion about the lawsuit that I have; but....it has to be fought and won.
A patent victory with a few early year great growth weeks would put a lot of steam behind our shovel.
I also looked at the list of historical Threshold lists for later Dec 2013, and AVNR doesn't appear.
I dont know if our Institutional clients hold AVNR shares in a way that allows institutional interests to prevent their use by traders that want to short our stock. It would appear that they allow such use, and probably enter into arrangements allowing them to profit from the "borrowing" of their shares.
That said, there always seems to be enough shares available to the shorts to allow them to cover their short positions on a daily basis.
I have paid a lot of attention to naked shorting of AVNR shares in the past. I don't think it is an issue today.
Chico - I used to know the route to the SHO report - what do you google or what is the request on the NASDAQ site for the current SHO report? Last I checked, AVNR hadnt been on the report for years
Yes, not fun. If I remember correctly there was reason behind their madness. I thought the final study for DNP was supposed to be huge, expensive and require a partner. MS was something we thought we could do on our own, and they thought we had the answer. Yes it was Pie in the sky, but this entire business is pie in the sky.
I think your original conclusion that we will all learn from this is the key. The important thing is to take the next step forward. But, I'm sure they are going over the details. What drug was in the placebo??? Remember Yakatan won a huge battle with the FDA over using a placebo with active ingredients for Abreva.
At this point all AVNR can do is release the bad news. It sounded as though we may have done some good for MS patients, but that the placebo did just as well??? It sounds to me as though this effort with MS needs to be broken down.
