Thanks Fugitive for your input on this board, it is greatly appreciated....and also, Thank You for your service to the community as a Deputy...my father was a State Trooper and I got to see first hand what police officers go through daily and are seldom thanked for the risks they take and the stress it places on their lives...have a great Thanksgiving Sir!!

  • Interesting read if you want to see how they operate and think, U.S. District Judge Lee Yeakel, Western District, Austin discusses patent Markmans...this is info straight from the horses mouth of how these work...

Google this since Yahoo won't let me post links...(really lame)...

They were shopping for buyers and it seems they got little response but SPEX was standing there as the only buyer....If you were the only buyer in the market would you say "give me the WORST that you've got for 110 million dollars, a bunch of stock and we'll split what we make on them"....I wouldn't...I would say "We'll take these good ones for 100 million and offer you stock and share profits"...that sounds more like a way better deal for everyone involved...

Maybe so but SPEX doesn't infringe on anyone's patents so why would anybody sue them...another great reason to have Rockstar as a big name majority SH...but as a SPEX shareholder what happens to MS / Apple / Sony share price doesn't affect me nor does them being sued by anybody else...

That was my first thought...on the surface when I read that Rockstar may sell out and Apple wants to get out that it was bad news...or at least very confusing...but then it dawned on me...why is Anthony Hayes tweeting this as if it's GOOD news and then I thought...Hayes just put out a PR about how his patents and lawsuits ARE NOT RELATED to Rockstar and they operate independently of Rockstar....hmmmm....someone was trying to make it very clear that what happens to Rockstar has no bearing on the future of Spherix...

I do however see that this patent portfolio has teeth to the tune of 188m...what if SPEX got the best ones?...how much would our settlement be with Cisco?....

This has to be an old article...when is it dated...

"Bloomberg's sources note that the patents up for sale aren't involved in any court cases."

SAY WHAT?????...they have MANY cases with patents that they bought...this article is SOOOOOO OLD!!

Just googled it...that article was released on Christmas Eve...LAST YEAR....completely invalid today...

I agree with the more is going on than we will know except for the "never" part...

I'm sure there is some mega negotiating going on all around this patent portfolio behind the scenes...me as a small time investor won't know what is going on in the big leagues until I wake up one morning and SPEX is at $20 for whatever they big boys had in the works or a massive settlement news hits...I'm just that small fish riding on the whale...

or it could go the opposite and it goes to .50 on news of a loss...that's the risk I'm taking...huge upside vs I can lose half of my investment...GLTA

I say let Apple go if they want and either MS or Sony etc...can pick up their shares or just outright sell them to someone interested in jumping in...what if Cisco, RPX, or even Google has a second chance to buy the Nortel patents?...I'm sure they aren't gonna pay 4.5 billion but who cares, SPEX has their own patents now and really don't need Rockstar IMO...what if SPEX got a 188 million from Cisco like Rockstar did, what would our SP be on that news?....

They have UP TO 60 days....the judge decides when...like any legal case, it depends on how strong the cases were and how much time the judge needs to sort through it all...if she believes that SPEX's case is bullet proof she may rule today or this week....if she thinks that both sides may have good arguments it may take longer for her to decide....we must be patient in this and realize that the news can come out at any time, it's a good idea IMO to be on board and ready to go because even 10 minutes of trading on good news with this low float could mean disaster for somebody watching SPEX for months...I think it would sail past $2 - $2.50 in a minute with positive Markman news and from there....who knows...GLTA

    What else can they say?...

I don't mind this PR, it shows that the company is following through with us investors and keeping us in the loop as requested...I emailed asking them for any kind indication of how things went and they just did..."We are pleased with the efforts put forth by our legal team to pursue enforcement of our intellectual property rights and now await the Court's decision."

If they were to be irresponsible and were to issue a press release like 'We sure are gonna win folks...they don't have a chance cause we beat them up in court" people would invest and if for any reason it went against them they would be jacked and wanting to sue for misleading PR....

This just keeps getting more and more interesting...now Apple wants out of Rockstar and Rockstar is looking at buyout...what does this mean for SPEX?..... not sure but here are questions in my mind....

What happens to their shares if they get bought out?

Did SPEX cherry pick the best one's if they knew that Rockstar may dissolve?

If somebody buys out Rockstar, will they go after SPEX to buy them out too? If so, how much would it take?

I already emailed IR about news...no guarantees there...they will release what they can, when they can...it could be Monday...or it could be 60 days from now which I believe is how long the judge has to respond...that's what makes this a either you're in or you're out stock...no news dropped it .08 this am so the volatility is very real...10 cent swings is the norm here.... and when news does come and you're having lunch or took the day off, you could be staring at 2.50 - 4.00 for share price pretty quickly depending on the nature of the news...

Let's say they get a similar deal as Rockstar with 188 m and release that news ...how many minutes would it take for this to go to $4 if all of the shorts have to cover and buying interest goes through the roof with a 25 million float? (which by the way Rockstar owns a bunch of and won't be selling)...This is why if I do take any profits I usually get right back in so I don't miss the pop...GLTA

As a matter of fact they released that they are not a part of the Rockstar settlement to make sure that people wouldn't speculate that they are...I personally like that because if Rockstar got 188m, they would be splitting with all involved...since SPEX is their own entity with separate lawsuits they may get MORE than 188m and not have to split it either...

This could be one of the many factors that killed the momentum but they must have felt inclined to clarify to the world that they are not part of that settlement regardless if Cisco asked them to be added...

Who would have guessed it...downtrend on day before and day of Markman...we waited months for this and it's like somebody called the cops on our party...thoughts?...The potential is only growing with these big settlements for Rockstar but it seems as though either the sentiment has changed?...or manipulation at work?...shorts?...who knows....I hope they are in that courtroom right now handing azzez to Uniden and Vtech...

And I think of all of the people who sold today and now more good news...Google AND Cisco don't wanna fight over these Nortel patents...ahem....they BOTH bid on these patents so it's no wonder why...what does that say about our chances of slamming them in court for the one's we own...I could not believe the selloff today but we'll see how it finishes...especially since that story came out at 1:30....just an hour and a half ago...GLTA
