    They are not "giving legal notice that they are buying before the earnings call". They are under no obligation to buy back any shares at any time. That's just ridiculous.

    You are making assumptions about what CY said. Yesterday Cypress said this: "SAN JOSE, Calif., January 20, 2016—Based on information available to date, Cypress Semiconductor Corp. (NASDAQ: CY) today confirmed the fourth quarter 2015 financial outlook it provided on October 22, 2015."

    The financial outlook provided October 22 was this:
    "FOURTH QUARTER 2015 FINANCIAL OUTLOOK
    For the fourth quarter of 2015, Cypress estimates non-GAAP financial results as follows: net sales in the range of $430 million to $460 million, gross margin of 41%, and diluted EPS in the range of $0.11 to $0.15."

    What I am suggesting is that if they come in at the low end of guidance and cut the Q1/1H forecast, the stock will drop.

    CY Q4 guidance from last qtr conf call:
    Revenue range $430 to $460 (Analysts Estimate $445)
    EPS $0.11 to $0.15 (Analysts Estimate $0.13)

    CY confirms guidance will be in line with estimates....the question is where in the range will they land. If at low end of rev/earns and if outlook is disappointing, stock will sell off.
