2 things , the people I saw interviewed at the riots didn't seem like welfare trolls and some of the bad behavior was caused by interactions of Trump supporters with the protesters. The welfare trolls generally don't show up at these types of events. The protesters are for the most part genuine people appalled by the Trump hatred. You failed to mention the Trump supporters attacking protesters egged on by Trump himself. When Trump runs a campaign headlined by race bating as its centerpiece you are going to get ugly reactions. Remember no other candidate has such issues. True intentionally bring it on. He is a martyr. Red meat for the base.

If you have such a fear, always get more than one applicant and you have the right to hire who you chose is the best fit for your Co. Being a felon can be an eliminating factor. Felons get this oh too well. This law only allows them to not be eliminated at the first step of the hiring process, an opportunity to impress someone to take a chance on them. I think it is workable and maybe we get 500,000 people jobs who otherwise would not had a shot.
This is not new territory. Example, past employer says applicant was fired for violence in the workplace, you hire them anyway and they kill a co-worker. You have real problems as an employer. Big money problems. Every employee we ever hired had a National Agency Check, reference and past employer verifications.academic check. You don't want jury trials over these issues. You NEVER hire violence in the workplace dismissals.
You can get sued for negligent hiring. In todays world you need to do some DD or be at risk if the employees does something awful that you should have detected in the hiring process.

I know of no employers who make a job offer before a background check of some sort. Your record can be used against you. You just don't have to revel it on an application.
You get to ask about the background but not on the first part of the process. Actually I think this is about getting people who have a hard time of getting hired and staying on the streets at least a look. So many people have records over drugs , not armed robbery and such. As a person who hired a lot of people yes it may be a hassle, but maybe overall society benefits from it long haul. I fired an employee for accepting several collect calls from prison FYI.
