I find nothing objectionable in your post. In a previous post I speculated that a ruling would come by December 15th but I should have clarified that to say that IMO if a judgment is published in 2013 it will happen prior to the last two weeks of the year. I can easily see the judge and his clerks letting this slide until after the New Year. They are in no hurry and, being human like the rest of us, may find it to be less stressful to their lives to render the Opinion in January.
I am no day trader and find the relative time of waiting to be of no consequence.

Listen, I have a sizable long position and I have my own source that confirms that AVNR management is very optimistic about the suit. I just posted last night that I think AVNR wins handily.
BUT..... saying that AVNR is 100% positive about anything involving a federal judge's yet unpublished Opinion is silly. Furthermore, your "later today" comment moves your post into the realm of unnecessary hype. This is a holiday week and I will give you 50-1 odds there will not be a decision this week.

I am not a patent attorney so please understand that when I give my opinion it is not coming from a position of personal expertise in this highly specialized area of the law.
Having said that, I believe AVNR will prevail handily. I would not be long this stock if this were not the case.
What he meant was, by the Judge not granting the Plaintiff's objection, the Defendant's won't have that "granting the P's objection" as one of their grounds to appeal.
As you know, Stark, like most other Federal judges, probably does not write his own opinions but rather directs his clerk(s) who will come up with a draft that he will put his final touches onto. It's his opinion, but he probably doesn't write it.
Having said that, his clerk or clerks should have already been instructed on what Stark wants to see in the final Opinion. Since this case doesn't appear to break any new ground they should be through pretty quickly.
All that to say.....
Judges and their staff HATE working during the holidays. There is NO WAY Stark or his clerks will be messing with this or any other decision Christmas week. I predict they will wrap this up and issue the Opinion by the fifteenth and say adios until the New Year.

I should amend the last sentence of my earlier post to read:
