Handal & Associates Slaps Nebraska Motorcycle Brake Company, GMA Engineering Inc., With Patent Infringement Suit

SAN DIEGO, CA--(MARKET WIRE)--Nov 19, 2008 -- Michael Maldonado, inventor and owner of Heavy Cycle Customs, has sued Nebraska motorcycle custom brake company GMA Engineering Inc. for infringing his patent. The suit, filed in the Southern District Federal Court in San Diego, California, seeks what is estimated by Maldonado's attorneys to be millions of dollars in damages.

In the lawsuit, Maldonado claims that GMA Engineering, its founder William Gardner, and other sued defendants wrongfully infringed upon Maldonado's U.S. Patent No. 5,992,587. According to the suit, Maldonado's patent concerns a special belt/chain drive system that incorporates a braking system within the drive assembly. This unique system, the suit alleges, reduces weight, improves performance, and improves the aesthetics of the rear wheel of a motorcycle.

The suit charges that GMA Engineering and Gardner wrongfully infringed Maldonado's patent by manufacturing and selling infringing products based on his patent in GMA Engineering's catalogs and its online store. Maldonado seeks to recoup the profits GMA Engineering and Gardner are alleged to have earned by allegedly selling parts based on Maldonado's invention.
