Trex wins appeal of patent case

Federal appeals court affirms ruling that Trex has not infringed on Nystrom patent

WINCHESTER, Va. (AP) -- Decking and fencing company Trex Co. said Wednesday a federal appeals court affirmed an earlier ruling that the company has not infringed on patents owned by a man who first sued the company eight years ago.

The company said the court upheld a U.S. District Court ruling on the case brought by Ron Nystrom, who started litigation against Trex in 2001 over the company's hidden fastening system.

It was not immediately known if Nystrom has a lawyer, and contact information for him was not immediately available.

Shares of Trex rose 34 cents to close at $19.35.
