Did Bumbo Ignore Child Safety in Favor of Profits?

Like millions of other parents over the past several years, Kevin and Lucy Ferrell used a new baby product called the Bumbo Baby Sitter that they bought at Toys R Us to prop up their son, Colby. The simple molded plastic seat is more upright than a bouncy chair, and less rigid than a high chair, making it a hit with parents looking for new infant gear.

But when 9-month-old Colby fell out of the seat and fractured his skull, his parents learned very quickly that the seat wasn't ideal for a small, moving child.

"He arched his back up and he kind of flipped out of it sideways and backwards and rolled right off (the table)," Kevin Ferrell says. "It just happened in a split second."

Bumbo, which is used to help babies sit up before they're able to do so on their own, has been an unquestioned success in sales - with nearly 4 million sold in the U.S. since 2003. But its safety record is uncertain.

The South African company recalled Bumbo in 2007 after a spate of 28 injuries reported to the Consumer Product Safety Commission - including numerous skull fractures - and placed warning labels on the seats that said they shouldn't be used on elevated surfaces. Bumbo company records obtained as part of a lawsuit the Ferrells filed in June against the company and Toys R Us, where the product was purchased off their baby registry, show some 300 reported incidents, including some in other countries, mainly Great Britain. The suit was filed in U.S. District Court in Austin, Texas, where the case is still in a pretrial phase.

Then in late November, the CPSC issued an unusual warning that there had been another 45 incidents since the recall, and that it had learned of another 18 older cases. It also noted that children were hurt both when the product was elevated and when it was on the ground.

Ross Cunningham of the Rose Walker firm in Austin, who represents the Ferrells and says he has settled a dozen lawsuits over Bumbo's safety, alleges in the lawsuit that Bumbo "has taken no effort" to reconfigure the product to prevent children from getting out of it, "despite having actual knowledge of the dangers associated with the Bumbo Baby Sitter...and the potential of the Bumbo Baby Sitter to cause serious injury to children."

Bumbo's U.S. attorney, Tarush R. Anand, says he cannot comment on the litigation, but did provide a statement from Bumbo, in which the company says the product is safe. "The Bumbo baby seat is a safe product for infants when it is used as intended: on the floor and never on an elevated surface," the statement says. "Children should always been closely supervised when they are in the Bumbo seat." The company also says it is working with the Consumer Product Safety Commission to educate parents on the correct use of the seat.

Toys R Us is accused in the most recent lawsuit of knowingly stocking a baby product that has caused injuries. One of the company's buyers is quoted in the litigation as saying under oath that she had never seen an infant product like that without a safety restraint, and that after learning about the severity of the injuries, she didn't think it was safe.

Nancy Cowles, executive director of the advocacy group Kids in Danger, notes the product - unlike cribs, car seats and high chairs - is not governed by any government or industry standard. The Ferrell lawsuit says Toys R Us has a huge profit margin on the seats and has ignored even voices from within the company about their safety.

Toys R Us spokeswoman Katie Reczek said in a statement in response to questions that the retailer followed the terms of the recall and stands by the decision to keep selling it.

"The safety of the products we sell is, and always has been, our highest priority," Reczek said. "At the time of the recall of the Bumbo Baby Sitter, we immediately removed the product from our store shelves, and worked with Bumbo to update the warning labels on the packaging, as was required. This warning label cautions parents not to use the Bumbo on elevated surfaces. Due to the recall and labeling process, the product was off the sales floor and was not available for purchase for several months. We continue to offer Bumbo products in our stores, and as always, we closely monitor all product safety issues."

Its only competitor, bØbØPOD, added a seatbelt after the Bumbo recall.

Attorney Cunningham alleges in the Bumbo lawsuit that safer alternative design existed. "Specifically, Bumbo could have incorporated any combination of the following design changes: made the Bumbo Baby Sitter wider at the base, raised the side and back walls of the seat, installed a bulbous pommel on top of the post in between the child's legs, and incorporated a safety harness, seatbelt or other securing device...that would sit low and tight across the child's hips. These, and possibly other design improvements, would have prevented a child like (Colby) Ferrell from falling out of the Bumbo Baby Sitter."

The Ferrells are now evangelists for seatbelts. Says Kevin Ferrell: "For me, it was important, if nothing else, to try to prevent (this) from happening to future parents and kids."

    that is sad... when I see all the immature comments of others..... the fact is... it can happen to parents that aren't stupid... just like a million other times a kid gets hurt and you think you could have handled it differently so they would not have. Shoulda coulda woulda! I had my son at 4 months old get his skull fractured by the bebe seat that I bought 5 years ago and never recalled unlike the bumbo. I had him up on the counter but I was not aware that they could fall out of it..... I thought it kept them in. I did not see the small lettering that was the same color of the seat underneath the seat. You have to flip it over to see it. I did not hear the recalls of the bumbo. I had him beside me and never left his side... when I heard a loud bang and there he was on the floor. I have talked to countless people that do the same or put the babies on the table because they never knew and thought it was safe. They need more warnings about this product... on the product and on the news and consumer site. I will never use this product again... since I have read that there were skull fractures even when the baby was placed on the floor in these things. I am not a stupid person.... but it happened to me.... and it has happned to lots of others. You guys should rethink what you say... because everyone has mistakes and accidents that they might second guess themselves. Instead of thinking 'stupid parents' .. how about 'poor baby'! Shame on you!

    So, they put him on the table, even though the label said not to, and then he fell out and on to the floor. Now the parents are suing the company for using a product against warning labels, and for neglecting to watch their child. Good one.

    Ya Know!!!!!!!!!! What kind of idiots are these parents!!!!!!!!!!!! My Kid was awesome in the bumbo!!!! Of course I DID NOT Put him on the table!!!!!!! Why don't you guys just put him out on the lawn tractor for a spin. I guess the tractor does say "Do Not let Your young children ride alone"!!!!!!!!

    After reading this I decided that I’m going to sue Ford. I set my newborn on the hood and as I was driving down the road he fell off! Can you believe that? How dare the Ford motor company produce such a harmful and inferior product! I’m so enraged at them right now!!!!

    REALLY!!!!!!! what #$%$ puts there kid on the table to begin with... and i'm sure they were no where around when their 9 MONTH OLD KID WHO MORE THAN LIKELY CAN SIT ON HIS OWN... flipped out of this thing..... maybe the parents should use the bumbo as a retard helmet because i'm pretty sure they are made out of the same material, and there IQ is way less than 70....

    The only problem I see in this situation is the #$%$ lawyers that manage to convince JUDGES that something is unsafe when in reality it is not the product but the user. People you must be at least 10% smarter than the object ok?! Seriously #$%$!?? I have a 7 month old and I've been putting her in her bumbo since 3 months. she LOVES it, and frequently arches back to tell me "mom I want out" why doesnt she go flying out and bash her head in? Oh! BECAUSE I AM HER MOTHER AND ACT AS SUCH! Therefore, I am within arms reach can pick her up out of the seat. This is infuriating.

    There probably isn't anything wrong with the chair, it's the stupid parents who would put it on a table or put the child in it anywhere and not supervise him/her every minute. That's what being a parent means, supervision of every waking minute. If the chair wasn't going to work out, supervision would have revealed that and its use should have been discarded. As parents look for items to take the place of supervision, accidents are sure to follow. If you can't be bothered, why did you have the kid anyway?

    Bumbo could very well win this fight in court, but the cost of the defense could be in the hundreds of thousands of dollars. No matter how you look at it, the company is losing, which is why they will likely settle it out of court; which is why most companies do come to an agreed settlement.

    Thats the sad state of affairs in the US and the very open ability to sue and seek damages for a variety of reasons. Maybe we should adopt the guidelines that Canada follows....if these morons lived in Toronto, there would be no suit.

    I live in Austin and right now I would like to sue Ross Cunningham ( their attorney) for encouraging stupidity and then blaming it on others.When I was a baby back in the 70s one of my parents actually had to pay attention and even then sometimes #$%$ happened...Cunningham and Ferrells stop looking for easy money and realized you screwed up like most parents do at some point.

    I used the Bumbo with my son and had no problems what so ever, and he was a preemie :) You don't have to be a genius to figure out that you should NEVER put a baby on a table in anything, it shouldn't have to say do not use on a table, you should just know that...shame on these parents for suing Toys R Us and the Bumbo company for what is obviously their own neglect...

    I hope the parents of this child has read these comments and realized how dumb they really are...I'm not the one to judge people when I don't know them but they make it really hard not to. I have browsed through these comments and the ones I have looked at no one has agreed with the parents. Once again... people trying to make an easy dollar. Or its like a lot of people I run into now days, its always, lets point the finger at somebody else I don't do wrong its all the other people not me. Why don't you take the responsibility and admit you screwed up. Come on people

    Personally I think if all those parents who use the item for other than its intended use whos child got seriously hurt were charged with child neglect maybe parents would start paying attention and recalls like this would not be needed. the instructions clearly state not to use on an elevatd surface and to supervise your child while using it - it is NOT the company's fault that parents cannot follow such simple instructions.

    its always been my thought, that when used correctly, a bumbo is a perfectly safe item. it's when IDIOT parents put one on oh the counter on their kitchen island or on a table that all hell breaks loose. this isn't a design flaw, its a parental judgement flaw. i have a bumbo, i've let my daughter use it - when its on the FLOOR !!!!. for the record, we have yet to have an accident =)

    There is a major difference in a product being unsafe and the environment and lacking supervision resulting in injury or worse. Take an inflatable pool for example; is the pool dangerous simply because it holds water? Or is no adult supervision the reason children drown in them...and bathtubs....and toilets....and in ground pools?

    Common sense says to not put an (very evident) unstable product on a table and stray outside of arms reach from your child. Your job as a parent is to protect them from injury and sometimes products can harm your child if not used properly. Bumbo should fight tooth and nail against all lawsuits...no more settlements. Parents are often the reason for the injury, but if a product is in the equation, its easy to blame the product and sue the manufacturer.

    Ferrell's; you are the reason your son was hurt, not the Bumbo. Do you leave him unattended in the bath tub too? Would you sue Bath Fitters?

    So did everyone click on this link while thinking “what’s wrong with this company!”, and then suddenly transition to “WHAT’S WRONG WITH THESE STUPID PARENTS!” after reading the part about the children being on the TABLE?

    That’s exactly what I did.

    I have two children who are both beyond the age to use a device like this, and we never had one even when they were small enough. But we did have things like the bouncer, which is kind of a small barcalounger for babies. But we were never stupid enough to put it on a table.

    Parenting is the ultimate “figure it out as you go along” job, and is very challenging, but some things are just obvious… like the fact that babies squirm and could easily fall off of a table. You shouldn’t even put them on a changing table without keeping a firm grip on them.

    That’s not to say that this device is ok as is… it probably isn’t and children could still hurt themselves even if falling over on the floor in this seat. But parents need to use some common sense and good judgment as well. And they should stop trying to blame someone else for their own stupidity.
