Job bias claims at record level, as religion and national-origin complaints increase

WASHINGTON (AP) -- Federal job discrimination complaints rose to an all-time high last year, led by an increase in bias charges based on religion and national origin.

The Equal Employment Opportunity Commission received nearly 100,000 charges of discrimination during the 2011 fiscal year, the most in its 46-year history. That's a slight increase over the previous year, which had 25 fewer complaints.

Charges of religious discrimination jumped by 9.5 percent, the largest increase of any category. Claims of bias based on ancestry or country of origin rose 5 percent.

Experts say the increase reflects the growing diversity of the nation's work force.

"We're seeing a greater diversity among minority groups in America," said Ron Cooper, a former general counsel of the EEOC who now works in private practice. "We're seeing more workers from India, Pakistan and other countries that bring additional religious complexity to the work force."

The commission does not specify which religious or ethnic groups filed the most charges.

As in past years, claims based on race, sex and retaliation were the charges filed most often, according to commission data.

Charges of racial bias fell by 1 percent, while sexual discrimination claims fell 2 percent and sexual harassment claims dropped 3 percent.

At the same time, claims of disability bias climbed 2 percent and charges of discrimination based on age rose 1 percent.

    Why is nothing being done about age discrimination? Companies love my qualifications but back away as soon as they determine that I am over 50. It is so blatant and so unethical, also against federal law. Employers still continue to do it and not even get challenged.

    What about AGE ?? When you hit 40 you can't even get a job flipping burgers.I'am 53 and have been looking for work over a year now after my job in land surveying went bust after 8 years.I never missed a day,worked in blazeing heat,freezing windy cold carrying a 25lb backpack and tri-pod over my shoulder,chopping my way through vines,laurel,briars while climbing up the side of a mountain.I made measurements,kept notes,collected data,kept time the whole 9 yards.Before that 13 years in Healthcare,been trying to get back on with them also.But looks like I can't even get a McJob.
    Due to being contract labor 1099 I get no unemployment,so I've been busted down to selling my stuff,renting a room out,odd jobs and before food stamps,dumpster diveing for food,clothes and anything I could find to sell.Took less gas to get to a dumpster than a food bank and many times had to walk.
    I have a 11 year old with cancer,haven't been able to do birthdays or xmas,but do cook a good meal for him when he's here.I apologise to him that I can't do more and he'll tell me "thats ok dad,haveing family is more important and I love you"
    I've got wolves at the door trying to figure out how to pay the property tax,house payment and keep the power on while applying for anything posted.
    I'am just one of many struggleing to get by.I have tryed to help others,giveing several folks a free place to stay even though I couldn't afford it.Misery loves company I guess,and I have a hard time saying no to those worse off.
    I don't mean to whine,,this is just my fact of the matter storie,piled with all the others.I've got a feeling theres going to be alot of folks just like me out in the streets this spring.Maybe insted of a job,I too will find a Occupation.Even though you may not agree 100% with every little micro managed detail,there comes a point were you are forced to make a stand,and I'am quickly reaching that point..
    Isn't it about time to put the BOOM back in BabyBoomer ?? Good luck to all you out of work/homeless folks out there..

    I think age discrimination is the biggest discrimination of all and one very hard to prove because the 'old' people are weeded out early in the interview process and never offered the job.

    Yes, indeed. Age discrimination is rampant. What is the WORST age to be looking for a job? Data shows ages 40-55! That is the biggest chunk of the unemployed.
    Why? They are savvy, they have experience, they know their work value. Much easier to get an inexperienced younger person for cheaper, or an oldster heading into the end of their career who will take what they can get (or to supplement their retirement, etc) than to pay somebody at the top of their earning power what they really deserve.

    I am 49 and cannot find a job, I always make it to the very end and final interviews but am usually sitting in a room with other candidates half my age. I have a friend who was interviewed by someone wearing pj pants and Uggs. Things are very different now and many people like to lump people in their 50s with those in their 70s. Unlike my parents I will never get to retire so you don't have to worry about my leaving. I have a BA and a JD and will work hard and can learn. Age discrimination is rampant!

    Not surprising with the job market the way it is and everyone at temp jobs. Lots of dislocated workers. People arent in their original career fields. Its not a good time.

    Why aren't they listing AGE discrimination as #1. It is a fact, plain and simple. I have been told by my bosses not to hire anyone over 45. WHAT??? They make claims that ins rates will go up, they have to pay more for the experience they have, blah, blah, blah! AGE is the reason why unemployment for those over 45 is the highest. I'm 53, the only thing saving my butt is I've worked there 30 years. I run the frickin company, I KNOW everything they do, good, bad, and the ugly. I will bet my last dime if they could get away with firing me they would. I have been asked...when are you retiring? Why don't you take time to be with your grandkids? I'm terrified to even take a vacation now, for fear I'll lose my job for any reason they can think of. I make sure I dot my I's, and cross my T's. I had a heat attack 2 years ago, I was back on my laptop 4 days later afraid I would get behind in my work and be fired. These are very hard times, and people over 45 or even 40 are at risk of being fired, or never getting hired again.

    Yes,to me agediscrimination is the worse, i know its been used against me more then once. employers would rather hire some young kid who does a lousy job, shows up when they feel like it, calls off on over time days and just plain lazy and goofs off,then to hire the older mature worker who does the job and works all the hours required

    I am 56 and I know that age discrination is running rampid,if you are over 45 and have been unemployed in the last 3 years you already know this.It doesn't matter how much experience you have,a company will be able to hire a younger person and train him the way they want him to be for less money and that is who they will hire.

    Once you reach a certain age in America, they think you have no more importance. Everyone knows with age comes wisdom and vast knowledge coupled with experience. Older employees can and will enhance a workforce for the betterment of all. The younger generation also benefits by learning by example and respect. Its a win win situation for all involved. Remember it takes a village.

    When I applied for a job in usa many years ago I had no problem to get that opening position, but some years later the management was changed and an #$%$ shyte mexican became the leader so he started to recruit ONLY Mexicans and he created an awfull working place for others to leave and quit...that company went bankruped soon after!

    people from india and pakistan as victims in the american work force?? really!?!? on a side note good luck in having an indian or pakistani hire you if you are not one of them! then check out there tolerance of other religions! now that would be a real eeoc case!
