Banfield operates hundreds of pet care outlets located in PetSmart stores throughout the United States.

In particular, Hagens Berman is investigating reports by consumers that the OWPs are advertised and sold in a misleading manner, with exaggerated cost savings, unfair service restrictions, and harsh cancellation policies that are improperly disclosed.

Banfield presents the OWPs to consumers as a tremendous cost-savings over retail costs for essential preventive pet care services. Hagens Berman attorneys believe, however, that Banfield inflates retail prices and bases advertised savings in part on the use of unnecessary services and/or services that are not actually provided. In any event, plan purchasers would have to use an undisclosed number and variety of services over the course of the plan year to achieve even part of the savings advertised, according to attorneys investigating the matter.

In addition, the OWPs contain cancellation charges that apply even if the plan-holder’s pet dies during the year. Attorneys also believe that Banfield makes use of deceptive sales tactics when enrolling consumers in OWPs, including withholding the OWP agreement until after the consumer has already given his or her credit card for enrollment.
